AN ORDINANCE, vacating any rights, title or interest of the
District in a six foot (6’) wide utility easement granted to the City of
Kirkwood, said easement being in Lot 1 of “Dewberry Court”, a
subdivision according to the plat thereof as recorded in Plat Book 48,
Page 48 of the St. Louis County Records, in the City of Kirkwood, St.
Louis County, Missouri.
WHEREAS, the owner of the subject property has requested
this District to vacate the portion of subject easement, and this District
has no further use for said easement,
NOW, THEREFORE, BE IT ORDAINED, BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer District
hereby vacates any right, title or interest that it may have in the six foot
(6’) wide utility easement granted to the City of Kirkwood, said easement
being in Lot 1 of “Dewberry Court”, a subdivision according to the plat
thereof as recorded in Plat Book 48, Page 48 of the St. Louis County
Records, in the City of Kirkwood, St. Louis County, Missouri.
The Foregoing Ordinance was adopted August 8, 2002 by the following
vote-
Ayes – C.D. Seward, A.J. Soukenik, T.W. Purcell, and J.W. Siscel.
Nays – None.
