AN ORDINANCE, appropriating Three Hundred Thirty-five Thousand
Dollars ($335,000.00) from the Operation, Maintenance and Construction
Improvement Fund of Coldwater Creek to be used for project costs for the
construction of rock fill slope protection and appurtenances in Patterson Ln. -
Coldwater Creek Bank Stabilization (2001150); in the City of Florissant, Missouri;
and authorizing the Executive Director and Secretary-Treasurer on behalf of The
Metropolitan St. Louis Sewer District to enter into a contract with Dave’s Lawn &
Landscaping Services, Inc. for the aforesaid construction.
WHEREAS, the bid for the aforesaid rock fill slope protection and
appurtenances is Three Hundred Four Thousand Seven Hundred Twenty-one and
50/100 Dollars ($304,721.50), and the allowance for construction change orders
is Thirty Thousand Two Hundred Seventy-eight and 50/100 ($30,728.50), and
WHEREAS, the Director of Finance has certified that there is an
unencumbered balance in the above-named fund sufficient to pay the obligation
authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Three Hundred Thirty-five Thousand Dollars
($335,000.00) is hereby appropriated from the Operation, Maintenance and
Construction Improvement Fund of Coldwater Creek to be used for project costs

for the construction of rock fill slope protection and appurtenances in Patterson
Ln. – Coldwater Creek Bank Stabilization (2001150), in the City of Florissant,
Missouri.
Section Two. The Executive Director and Secretary-Treasurer are
hereby authorized on behalf of The Metropolitan St. Louis Sewer District to enter
into a contract with Dave’s Lawn & Landscaping Services, Inc. as the lowest
responsible bidder for the construction of rock fill slope protection and
appurtenances in Patterson Ln. – Coldwater Creek Bank Stabilization (2001150),
in the City of Florissant, Missouri, within The Metropolitan St. Louis Sewer
District, pursuant to bids received and opened on the 27th day of August, 2002.
Section Three. This ordinance, being an appropriation ordinance,
shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted September 12, 2002 by the following vote-
Ayes – C.D. Seward, A.J. Soukenik, T.W. Purcell, M.C. Williams, and J.W. Siscel.
Nays – None.
