AN ORDINANCE, vacating a portion of a five foot (5’) wide
easement and a portion of a seven and one-half foot (7.5’) wide easement
as established on lot 15, and a portion of the two five foot (5’) wide
easements and a portion of the a seven and one-half foot (7.5’) wide
easement as established on lot 16, and a portion of the two five foot (5’)
wide easements and a portion of a seven and one-half foot (7.5’) wide
easement as established on lot 17, and a portion of the two five foot (5’)
wide easements, and a portion of a seven and one-half foot (7.5’) wide
easement as established on lot 18, and a portion of a five foot (5’) wide
easement and a portion of a seven and one-half foot (7.5’) wide easement
as established on lot 19 and a portion of a seven and one-half foot (7.5’)
wide easement as established on lot 20, all of “Highland on Conway Plat
No. 2”, a subdivision according to the plat thereof recorded in Plat Book
83, Page 39 of the St. Louis County Records and shown on Adjusted
Parcel B of “Boundary Adjustment Plat of Lots 15, 16,17,18,19 and part
of Lot 20 of Highland on Conway Plat 2, in U.S. Survey 1911 & 370 in
Township 45 North-Range 4 East, City of Chesterfield, St. Louis County
Missouri”, a boundary adjustment according to the plat thereof recorded
in Plat Book 350, Pages 103 and 104 of the St. Louis County Records in
the City of Chesterfield, St. Louis County, Missouri.
WHEREAS, the owner of the subject property has requested
this District to vacate the portions of subject easements, and this District
has no further use for said portions,
NOW, THEREFORE, BE IT ORDAINED, BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The portion of the five foot (5’) wide easement
and the portion of the seven and one-half foot (7.5’) wide easement as
established on lot 15, and the portion of the two five foot (5’) wide
easements and the portion of the seven and one-half foot (7.5’) wide
easement as established on lot 16, and the portion of the two five foot (5’)
wide easements and the portion of the seven and one-half foot (7.5’) wide
easement as established on lot 17, and the portion of the two five foot (5’)
wide easements and the portion of the seven and one-half foot (7.5’) wide
easement as established on lot 18 and the portion of the five foot (5’) wide
easement and the portion of the seven and one-half foot (7.5)’ wide
easement as established on lot 19, and the portion of the seven and one-
half foot (7.5’) wide easement as established on lot 20, all of “Highland on
Conway Plat No. 2”, a subdivision according to the plat thereof recorded
in Plat Book 83, Page 39 of the St. Louis County Records and shown on
Adjusted Parcel B of “Boundary Adjustment Plat of Lots 15, 16, 17, 18,
19 and part of Lot 20 of Highland on Conway Plat 2, in U.S. Surveys
1911 & 370, in Township 45 North-Range 4 East, City of Chesterfield, St.
Louis County, Missouri”, a boundary adjustment according to the plat
thereof recorded in Plat Book 350, Pages 103 and 104 of the St. Louis
County Records in the City of Chesterfield, St. Louis County, Missouri
as shown hachured on the attached “Easement Vacation Plat”, and
marked Exhibit A, sheet 1 of 2 and sheet 2 of 2 and made a part hereof,
are hereby vacated.
The foregoing Ordinance was adopted October 3, 2002 by the following
vote –
Ayes – C.D. Seward, A.J. Soukenik, T.W. Purcell, M.C. Williams, and
J.W. Siscel.
Nays – None.
