AN ORDINANCE, vacating a portion of a ten foot (10’) wide
easement and a portion of a five foot (5’) wide easement as recorded in
Plat Book 97, Page 72, a portion of a ten foot (10’) wide easement as
recorded in Deed Book 4426, Page 439 and a ten foot (10’) wide easement
as recorded in Deed Book 4426, Page 437 of the St. Louis County
Records, said easements being in Lot 1 and Lot 3 of “Florissant Market
Place” a subdivision according to the plat thereof recorded in Plat Book
350, Page 311 of the St. Louis County Records, in the City of Florissant,
St. Louis County, Missouri.
WHEREAS, the owner of the subject property has requested
this District to vacate the portions of the subject easements, and this
District has no further use for said portions,
NOW, THEREFORE, BE IT ORDAINED, BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The portion of the ten foot (10’) wide easement
and the portion of the five foot (5’) wide easement as recorded in Plat
Book 97, Page 72, the portion of the ten foot (10’) wide easement as
recorded in Deed Book 4426, Page 439 and the ten foot (10’) wide
easement as recorded in Deed Book 4426, Page 437 of the St. Louis
County Records, said easements being in Lot 1 and Lot 3 of “Florissant
Market Place”, a subdivision according to the plat thereof recorded in
Plat Book 350, Page 311 of the St. Louis County Records, as shown
hachured on the attached “Easement Vacation Plat”, and marked Exhibit
“A” and made a part hereof, are hereby vacated EXCEPTING
THEREFROM the fifteen foot (15’) wide easement in Lot 3 of “Florissant
Market Place” as recorded in Plat Book 350, Page 311 of the St. Louis
County Records.
The foregoing Ordinance was adopted November 14, 2002 by the following
vote –
Ayes – C.D. Seward, A.J. Soukenik, T.W. Purcell, M.C. Williams, and J.M.
Swartz.
Nays – None.
