HomeMy Public PortalAbout11371 O R D I N A N C E NO. 11371 AN ORDINANCE, appropriating Two Hundred Thirty-five Thousand
Dollars ($235,000.00) from the Operation, Maintenance and Construction Improvement
Fund of Maline Creek to be used for project costs for the construction of rock lined
channel and a reinforced concrete retaining wall and appurtenances in Bristol Rock-
Tobaggon Trail Storm Channel (MCJB-130) (2000077), in St. Louis County, Missouri;
and authorizing the Executive Director and Secretary-Treasurer on behalf of The
Metropolitan St. Louis Sewer District to enter into a contract with MJC Constructors,
Inc. for the construction of the aforesaid project.
WHEREAS, the bid for the construction of said rock lined channel and
reinforced concrete retaining wall and appurtenances is Two Hundred Twenty-three
Thousand Six Hundred Thirty-nine and 25/100 ($223,639.25), and the allowance for
construction change orders is Eleven Thousand Three Hundred Sixty and 75/100
Dollars ($11,360.75), and
WHEREAS, the State of Missouri has agreed to contribute Ninety-nine
Thousand Nine Hundred Ninety Dollars ($99,990.00) toward the costs of said project;
upon the receipt of such funds from said source, said money will be returned to the
Operation, Maintenance and Construction Improvement Fund of Maline Creek, and
WHEREAS, the Director of Finance has certified that there is an
unencumbered balance in the above-named fund sufficient to pay the obligation
authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Two Hundred Thirty-five Thousand Dollars
($235,000.00) is hereby appropriated from the Operation, Maintenance and
Construction Improvement Fund of Maline Creek to be used for project costs for the
construction of rock lined channel and a reinforced concrete retaining wall and
appurtenances in Bristol Rock-Tobaggon Trail Storm Channel (MCJB-130) (2000077),
in St. Louis County, Missouri.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into a
contract with MJC Constructors, Inc. as the lowest responsible bidder for the
construction of rock lined channel and a reinforced concrete retaining wall and
appurtenances in Bristol Rock-Tobaggon Trail Storm Channel (MCJB-130) (2000077),
in St. Louis County, Missouri, pursuant to bids received and opened on the 4th day of
October 2002.
Section Three. This ordinance, being an appropriation ordinance, shall
take effect immediately upon its enactment.
The foregoing Ordinance was adopted December 13, 2002 by the following vote –
Ayes – C.D. Seward, A.J. Soukenik, T.W. Purcell, M.C. Williams, J.W. Siscel, and J.M.
Swartz.
