AN ORDINANCE, vacating any rights, title or interest of the
District in a portion of the private lane fifty feet (50’) wide, centered on
the common lot line between lots 1 and 23, known as Clayton Hills Lane,
also known as Mueller Lane, in “Clayton Hills” a subdivision according to
the plat thereof recorded in Plat Book 46, Page 32 of the St. Louis County
Records, in the City of Town & Country, St. Louis County, Missouri.
WHEREAS, the owner of the land has requested that this
District vacate any right, title or interest that the District may have in the
subject private lane, and this District has no further use for said private
lane,
NOW, THEREFORE, BE IT ORDAINED, BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer District
hereby vacates any rights, title or interest that it may have in the portion
of the private lane fifty feet (50’) wide, centered on the common lot line
between lots 1 and 23, known as Clayton Hills Lane also known as
Mueller Lane in “Clayton Hills” a subdivision according to the plat thereof
recorded in Plat Book 46, Page 32 of the St. Louis County Records, as
shown hachured on the Right of Way Vacation Plat marked Exhibit “A-2”
and made a part hereof, EXCEPTING THEREFROM, the ten foot (10’)
wide easement recorded in Deed Book 5257, Page 19 of the St. Louis
County Records, as shown cross hachured on the afore referenced Right
of Way Vacation Plat.
The foregoing Ordinance was adopted January 23, 2003 by the following
vote –
Ayes – C.D. Seward, A.J. Soukenik, T.W. Purcell, M.C. Williams, and J.M.
Swartz.
Nays – None.
