AN ORDINANCE, vacating any right, title or interest of the
District in a portion of a forty foot (40’) wide easement in former Chicago
Boulevard, reserved to St. Louis County for the Metropolitan St. Louis
Sewer District, for sewer purposes as recorded in Deed Book 6250, Pages
75 thru 78 of the St. Louis County Records, said easement being in
Block 12, part of Lots 3-19, Lots 20-36, Block 13 except Lots 37 and 38,
Block 25, and parts of vacated Roberts and Chicago Blvds. and
Werremeyer Place 16L411677, of Elmwood Park, a subdivision according
to the plat thereof as recorded in Plat Book 3, Page 41 of the St. Louis
County Records, in St. Louis County, Missouri.
WHEREAS, the owner of the subject property has requested
that this District vacate any right, title or interest that it may have in the
subject easement, and this District has no further use for said easement,
NOW, THEREFORE, BE IT ORDAINED, BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer District
hereby vacates any right, title or interest that it may have in the portion
of the subject forty foot (40’) wide easement in former Chicago Boulevard,
as recorded in Deed Book 6250, Pages 75 thru 78 of the St. Louis County
Records as shown hachured on the attached Exhibit “A” and made a part
hereof, is hereby vacated.
The foregoing Ordinance was adopted January 23, 2003 by the following
vote –
Ayes – C.D. Seward, A.J. Soukenik, T.W. Purcell, M.C. Williams, and J.M.
Swartz.
Nays – None.
