O R D I N A N C E NO. 11445
AN ORDINANCE, declaring the necessity for the acquisition of certain
real property within The Metropolitan St. Louis Sewer District for flood mitigation
purposes in the project known as Harlem-Baden Relief Phase II (North Pointe)
(2002037) to serve the needs of residents of the area, and authorizing the
acquisition of real property by purchase or by the institution of condemnation
proceedings.
WHEREAS, there exists within The Metropolitan St. Louis Sewer
District an area of the City of St. Louis within the Mississippi River Watershed
wherein live and work numerous people; and
WHEREAS, sanitary and storm sewage gathered from such area will
have no adequate means of disposition, and will constitute a menace to public
health and welfare of the general public and the residents of The Metropolitan St.
Louis Sewer District; and
WHEREAS, it is the purpose and design of The Metropolitan St. Louis
Sewer District to protect the public health and welfare by the acquisition of said
real property for flood mitigation purposes to relieve and alleviate these conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and relieve
insanitary and dangerous conditions, it is necessary to appropriate and acquire by

the exercise of eminent domain or otherwise real property for flood mitigation
purposes in the project known as Harlem-Baden Relief Phase II (North Pointe)
(2002037) hereinafter set forth, said real property being more particularly
described as follows:
Part of Lot No. 2 of Railroad Addition to Germantown and in Block No.
4244 E of the City of St. Louis, fronting ten feet wide of the west line of
Oriole Avenue, a private street 60 feet wide established by instrument
recorded Book 6847 Page 209, by a depth westwardly of even width, one
hundred thirty five feet 6 inches to a line which is the straight prolongation
south of the center line of a 15 foot alley laid out in English Grove; bounded
north by a line 610 feet south of the south line of Switzer Avenue, or
property conveyed to Regina Strauss by deed recorded in Book 6927 Page
514.
Part of Lot No. 2 of Railroad Addition to Germantown and in Block No.
9244-E of the City of St. Louis, fronting 50 Feet on the west line of Oriole
Avenue, a private street, 60 feet wide, established by instrument recorded in
Book 6847 Page 209, by a depth westwardly of 135 feet 6 inches to a line
which is the straight prolongation of the center line of a 15 feet alley laid
out in English Grove, north by a line 660 feet south of the south line of
Switzer Avenue, or by property conveyed to Leo J. Vogler and wife by deed
recorded in Book 6953 Page 324, and south by the remainder of the Plat 78
feet 9-3/8 inches, more or less, by 135 feet 6 inches conveyed to Sidney L.
Metz and his wife, which remainder.

Part of lot 3 of Railroad Addition to Germantown and in Block 5326 of
the City of St. Louis, having a front of 75 feet on the east line of Oriole
Avenue, by a depth eastwardly between parallel likes of 135 feet 6 inches;
bounded by a line parallel with a distant 160 feet south of the south line of
Englia Grove a subdivision or a line distant 490 feet south of the south line
of Switzer Avenue.

Section Two. Counsel for The Metropolitan St. Louis Sewer
District be and is hereby authorized to enter into contracts to acquire by purchase
if possible, or to institute and prosecute an action in condemnation pursuant to
the provisions of the Charter of The Metropolitan St. Louis Sewer District and the
laws of the State of Missouri for the appropriation of private property as
hereinabove set out.
The foregoing Ordinance was adopted February 20, 2003 by the following vote-
Ayes – C.D. Seward, A.J. Soukenik, T.W. Purcell, M.C. Williams, and J.M. Swartz.
Nays – None.
