AN ORDINANCE, vacating a portion of a twenty foot (20’)
wide easement as recorded in Deed Book 10827, Page 1879, and a
portion of a twenty foot (20’) wide easement as recorded in Deed Book
10827, Page 1882 of the St. Louis County Records, said easements being
in Big Bend Apartments Plat One, as recorded in Plat Book 346, Pages
420 and 421 of the St. Louis County Records, in St. Louis County,
Missouri.
WHEREAS, the owner of the subject property has requested
this District to vacate the portions of the subject easements, and this
District has no further use for said portions.
NOW, THEREFORE, BE IT ORDAINED, BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The portion of the twenty foot (20’) wide
easement as recorded in Deed Book 10827, Page 1879, and the portion
of the twenty foot (20’) wide easement as recorded in Deed Book 10827,
Page 1882 of the St. Louis County Records, as shown hachured on the
attached “Easement Vacation Plat”, and marked Exhibit “A” and Exhibit
“B” and made a part hereof, are hereby vacated, EXCEPTING
THEREFROM the irregular shaped storm water retention easement
recorded in Plat Book 346, Pages 420 and 421 and the five foot (5’) wide
utility easement recorded in Deed Book 2082, Page 497 of the St. Louis
County Records.
The foregoing Ordinance was adopted February 20, 2003 by the following
vote-
Ayes – C.D. Seward, A.J. Soukenik, T.W. Purcell, M.C. Williams, and J.M.
Swartz.
Nays – None.
