HomeMy Public PortalAbout11459 O R D I N A N C E NO. 11459 AN ORDINANCE, repealing Ordinance No. 11423, as adopted January 23, 2003, in order to postpone the bond election as scheduled for April 8, 2003 in The Metropolitan St. Louis Sewer District, with an emergency clause. WHEREAS, through Ordinance No. 11423, as adopted January 23, 2003, the Board of Trustees of The Metropolitan St. Louis Sewer District called for a bond election to be held on April 8, 2003 in The Metropolitan St. Louis Sewer District on the proposition whether to issue Five Hundred Million Dollar ($500,000,000.00) principal amount of sewer revenue bonds, and WHEREAS, the Board of Trustees now believes that the public would be better served if said election were postponed, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. Ordinance No. 11423, as adopted January 23, 2003, is hereby repealed in order to postpone the bond election as scheduled for April 8, 2003 in The Metropolitan St. Louis Sewer District. Section Two. The General Counsel and staff of The Metropolitan St. Louis Sewer District are hereby directed to pursue any and all legal actions as may be necessary to effect the postponement of said bond election. Section Three. Insofar as proper notice for the postponement of said bond election must be given to the Boards of Election Commissioners of St. Louis City and St. Louis County, respectively, without delay, and may require legal action, so that time is of the essence, thus creating an emergency within the meaning of the District Charter, this ordinance shall take effect immediately upon its enactment. The foregoing Ordinance was adopted March 10, 2003 by the following vote- Ayes – R. Baer, C. Brown, M. Rhodes, D. Joyce-Hayes, B. Margiotta, and J. Swartz. Nays – None. Secretary-Treasurer
