AN ORDINANCE, vacating any rights, title, or interest of the
District in a portion of Butler Hill Road, fifty foot (50’) wide, as shown on
the Road Dedication Plat of “A Tract of Land being Part of Lots 5 and 6 of
the John Mullanphy Estate in U.S. Survey 2022, Township 43 North,
Range 6 East, St. Louis County, Missouri” as recorded in Plat Book 164,
Page 1 of the St. Louis County Records, and being in Outlot “A” of “The
Estates at Quail Creek” a subdivision according to the plat thereof as
recorded in Plat book 329, Page 43 of the St. Louis County Records, in
St. Louis County, Missouri.
WHEREAS, the owner of this land has requested that this
District vacate any right, title, or interest that the District may have in
the subject road right-of-way, and this District has no further use for
said road right-of-way,
NOW, THEREFORE, BE IT ORDAINED, BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer District
hereby vacates any rights, title or interest that it may have in the portion
of Butler Hill Road, fifty foot (50’) wide, as shown on the Road Dedication
Plat of “A Tract of Land being Part of Lots 5 and 6 of the John Mullanphy
Estate in U.S. Survey 2022, Township 43 North, Range 6 East, St. Louis
County, Missouri, as recorded in Plat Book 164, Page 1 of the St. Louis
County Records, as shown hachured on the attached “Roadway Vacation
Plat”, and marked Exhibit “A” and made a part hereof.
The foregoing Ordinance was adopted April 10, 2003 by the following
vote –
Ayes – R.J. Baer, M.A. Rhodes, D. Joyce-Hayes, B.J. Margiotta, C.
Brown, and J.M. Swartz.
Nays – None.
