AN ORDINANCE, vacating a portion of a ten foot (10’) wide
easement in “Villa Apartments”, a plat according to the plat thereof
recorded in Plat Book 143, Page 18 and located in “Revised Villa
Apartments” a plat according to the plat thereof recorded in Plat Book
151, Page 50 of the St. Louis County Records, in St. Louis County,
Missouri.
WHEREAS, the owner of the subject property has requested
this District to vacate the portion of subject easement, and this District
has no further use for said portion,
NOW, THEREFORE, BE IT ORDAINED, BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The portion of the ten foot (10’) wide easement
as recorded in Plat Book 143, Page 18 of the St. Louis County Records,
as shown hachured on the attached “Easement Vacation Plat”, and
marked Exhibit “A” and made a part hereof, is hereby vacated,
EXCEPTING THEREFROM, the fifteen foot (15’) wide easement recorded
in Deed Book 5943, Page 124 and the ten foot (10’) wide and irregular
shaped easements established by the plat of “Revised Villa Apartments”,
as recorded in Plat Book 151, Pages 50 of the St. Louis County Records,
in St. Louis County, Missouri.
The foregoing Ordinance was adopted April 10, 2003 by the following
vote –
Ayes – R.J. Baer, M.A. Rhodes, D. Joyce-Hayes, B.J. Margiotta, C.
Brown, and J.M. Swartz.
Nays – None.
