AN ORDINANCE, vacating a ten-foot (10’) wide sanitary
sewer easement originally recorded in Deed Book 6597, page 838 of the
St. Louis County Records and subsequently assigned to The Metropolitan
St. Louis Sewer District as recorded in Deed Book 13242, Page 1075 of
the St. Louis County Records, located in Lot 189, of Oak Tree Farm Plat
4 a subdivision according to the plat thereof recorded in Plat Book 117,
Page 76 of the St. Louis County Records, in the City of Ballwin, St. Louis
County, Missouri.
WHEREAS, the owner of the subject property has requested
this District to vacate the subject easement, and this District has no
further use for said easement,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The ten-foot (10’) wide sanitary sewer
easement originally recorded in Deed Book 6597, Page 838 of the St.
Louis County Records and subsequently assigned to The Metropolitan St.
Louis Sewer District as recorded in Deed Book 13242, Page 1075 of the
St. Louis County Records, located in Lot 189, of Oak Tree Farm Plat 4 a
subdivision according to the plat thereof recorded in Plat Book 117, Page
76 of the St. Louis County records is hereby vacated, EXCEPTING
THEREFROM the easements established by the plat of Oak Tree Farm
Plat 4 as recorded in Plat Book 117, Page 76 and the ten-foot (10’) wide
easement as recorded in Deed Book 13446, Page 2600 of the St. Louis
County Records, in the City of Ballwin, St. Louis County, Missouri.
The foregoing ordinance was adopted August 14, 2003.
