HomeMy Public PortalAbout11572O R D I N A N C E NO. 11572 AN ORDINANCE, repealing Ordinance No. 11554, as adopted July 24, 2003, in order to postpone the bond election as scheduled for November 4, 2003, in The Metropolitan St. Louis Sewer District, with an emergency clause. WHEREAS, through Ordinance No. 11554, as adopted July 24, 2003, the Board of Trustees of The Metropolitan St. Louis Sewer District called for a bond election to be held on November 4, 2003, in The Metropolitan St. Louis Sewer District on the proposition whether to issue Five Hundred Million Dollar ($500,000,000.00) principal amount of sewer revenue bonds, and WHEREAS, the Board of Trustees now believes that the public would be better served if said election were postponed, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. Ordinance No. 11554, as adopted July 24, 2003, is hereby repealed in order to postpone the bond election as scheduled for November 4, 2003, in The Metropolitan St. Louis Sewer District. Section Two. The General Counsel and staff of The Metropolitan St. Louis Sewer District are hereby directed to pursue any and all legal actions as may be necessary to effect the postponement of said bond election. Section Three. Ordinance No. 11554, as hereinabove repealed, mandated that the District's bond election be placed on the November 4, 2003, election ballots, and in order to do so, the District was to serve formal notice of said election to the Boards of Election Commissioners of St. Louis City and St. Louis County, respectively, and in order to rescind the mandate of said Ordinance No. 11554, the repeal of said Ordinance must proceed without delay, thus creating an emergency within the meaning of the District's Charter. Accordingly, this Ordinance shall take effect immediately upon its enactment. The foregoing Ordinance was adopted August 26, 2003.
