HomeMy Public PortalAbout11597O R D I N A N C E NO. 11597 AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to execute an Easement Agreement with Union Electric Company d/b/a AmerenUE for the construction, reconstruction, use, operation and maintenance of electric lines and appurtenances thereto upon, over and across certain real property of the District known as the Lower Meramec River Wastewater Treatment Plant property in St. Louis County, Missouri. Company WHEREAS, the Union Electric Company d/b/a AmerenUE has asked the District for the right to construct, reconstruct, use, operate and maintain said electric lines, over and across certain hereinafter described real property of the District known as the Lower Meramec River Wastewater Treatment Plant property, and the District is desirous of granting such right for the good of the general public. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and Secretary- Treasurer are hereby authorized on behalf of The Metropolitan St. Louis Sewer District to execute an Easement Agreement with Union Electric Company d/b/a AmerenUE for the construction, reconstruction, use, operation and maintenance of electric lines and appurtenances thereto upon, over and across certain real property of the District known as the Lower Meramec River Wastewater Treatment Plant property in St. Louis County, Missouri, said easement as herein granted being described as follows: A tract of land being part of U.S. Surveys 50 and 3051, Townships 42 and 43 North, Range 6 East, St. Louis County, Missouri. Said easement across the above-described property is more particularly described as follows: Commencing at a stone at the Southwesterly corner of Eiler Estates Subdivision as recorded in Plat Book 240, Page 11 in the St. Louis County, Missouri land records; Thence North 62˚22'28" East a distance of 400.24 feet to a point on the West right-of-way line of an existing transmission line easement one hundred (100) feet in width conveyed to Union Electric Co. by deed recorded in Book 2801, Page 614 in said land records, said point being the point of beginning of the easement herein described; Thence North 62˚22'28" East a distance of 153.74 feet to a point; Thence South 16˚00'09" West along said right-of-way line a distance of 15.00 feet to a point; Thence South 64˚46'39" West a distance of 132.96 feet to a point on the aforesaid West right-of-way line of said existing transmission line easement; Thence North 16˚00'09" East along said right-of-way line a distance of 15.00 feet to a point; Thence South 64˚46'39" West a distance of 446.60 feet to a point; Thence South 01˚03'38" East a distance of 1722.25 feet to a point; Thence South 03˚29'50" East a distance of 1436.69 feet to a point; Thence South 89˚31'42" East a distance of 469.89 feet to a point on the Southeast line of aforesaid U.S. Survey No. 3051, and being the Northwest line of a tract of land conveyed to Union Electric Co. (now known as AmerenUE) by deed recorded in Book 2535, Page 143 in the St. Louis County, Missouri, land records, from which point a stone at the most Eastern corner of said U.S. Survey No. 3051 bears North 63˚11'37" East a distance of 18.39 feet; Thence South 63˚11'37" West along said Southeast line of U. S. Survey No. 3051 a distance of 218.19 feet to a point; Thence North 89˚31'42" West a distance of 269.02 feet to a point; Thence South 03˚29'50" East a distance of 15.00 feet to a point; Thence North 89˚31'42" West a distance of 100.24 feet to a point; Thence North 03˚29'50" West a distance of 15.00 feet to a point; Thence North 89˚31'42" West a distance of 15.00 feet to a point; Thence North 03˚29'50" West a distance of 100.24 feet to a point; Thence South 89˚31'42" East a distance of 15.00 feet to a point; Thence North 03˚29'50" West a distance of 1431.88 feet to a point; Thence North 01˚03'38" West a distance of 1679.51 feet to a point; Thence South 64˚46'39" West a distance of 20.00 feet to a point; Thence North 01˚03'38" West a distance of 109.60 feet to a point; Thence North 64˚46'39" East a distance of 20.00 feet to a point; Thence North 01˚03'38" West a distance of 20.00 feet to a point; Thence North 64˚46'39" East a distance of 109.60 feet to a point; Thence South 01˚03'38" East a distance of 20.00 feet to a point; Thence North 64˚46'39" East a distance of 489.35 feet to a point on the aforesaid West right-of-way line of an existing transmission line easement; Thence North 16˚00'09" East along said right-of-way line a distance of 32.91 feet to the point of beginning containing 10.2 acres, as shown hachured on "Exhibit A" attached hereto and made a part hereof. Section Two. The Easement Agreement as herein authorized shall be comprised of such terms and conditions as are approved by the office of the General Counsel of the District. The foregoing ordinance was adopted September 11, 2003.
