AN ORDINANCE, vacating any rights, title, or interest of the
District in a portion of a forty-one foot (41') wide Access, utility, parking
and sidewalk easement as recorded in Plat Book 350, Pages 258 and 259
of the St. Louis County Records, said easement being in Adjusted Lot 2
and Adjusted Lot 3 of "Boundary Adjustment Plat of Lots 2 and 3 of
Bentwood", a subdivision according to the plat thereof as recorded in Plat
Book 351, Page 341 of the St. Louis County Records, in St. Louis
County, Missouri.
WHEREAS, the owner of this land has requested that this
District vacate any rights, title or interest that the District may have in
the subject easement, and this District has no further use for said
easement,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer District
hereby vacates any rights, title, or interest that it may have in the portion
of the forty-one foot (41') wide Access, utility, parking, and sidewalk
easement as shown hachured on the attached "Easement Vacation Plat"
and marked Exhibit "A" sheets 1 of 3, 2 of 3 and 3 of 3 and made a part
hereof, is hereby vacated, EXCEPTING THEREFROM, existing easements
recorded in Deed Book 6406, Page 1695 and Deed Book 6373, Page 1286
of the St. Louis County Records, in St. Louis County, Missouri.
The foregoing Ordinance was adopted October 9, 2003.
