AN ORDINANCE, appropriating Twenty Million Dollars
($20,000,000.00) from the Sanitary Replacement Fund to be used for
project costs for the construction of Lower Meramec River System
Improvement – Baumgartner Tunnel (95066B); in St. Louis County,
Missouri; and authorizing the Executive Director and Secretary-
Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter
into a contract with Baumgartner Tunnel Joint Venture for the aforesaid
construction.
WHEREAS, the bid for the aforesaid construction is Forty-
five Million Seven Hundred Twenty Thousand Dollars ($45,720,000.00),
and appropriations in the future fiscal years will complete the total
funding of said project, and
WHEREAS, the Director of Finance has certified that there is
an unencumbered balance in the above-named fund sufficient to pay the
obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Twenty Million Dollars
($20,000,000.00) is hereby appropriated from the Sanitary Replacement
Fund to be used for project costs for the construction of Lower Meramec
River System Improvements – Baumgartner Tunnel (95066B), in St.
Louis County, Missouri.
Section Two. The Executive Director and Secretary-
Treasurer are hereby authorized on behalf of The Metropolitan St. Louis
Sewer District to enter into a contract with Baumgartner Tunnel Joint
Venture as the lowest responsible bidder for the construction of Lower
Meramec River System Improvements – Baumgartner Tunnel (95066B),
in St. Louis County, Missouri, pursuant to bids received and opened on
the 17th day of September, 2003.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted December 11, 2003 by the
following vote –
Ayes – M.A. Rhodes, C. Brown, D. Joyce-Hayes, J.M. Swartz, and R.J.
Baer.
Nays – None.
