AN ORDINANCE, vacating any rights, title, or interest of the
District in a portion of a thirty-foot (30') wide Drainage Easement, which
exclusive rights were assigned to The Metropolitan St. Louis Sewer
District by The Trustees for Ballas Hills Ranch Subdivision as recorded
in Deed Book 5021, Page 340 of the St. Louis County Records, located in
Lot 7, of "Ballas Hills Ranch" a subdivision according to the plat thereof
as recorded in Plat Book 68, Page 33 of the St. Louis County Records, in
the City of Des Peres, St. Louis County, Missouri.
WHEREAS, the owner of the subject property has requested
that this District vacate any rights, title or interest that the District may
have in the portion of subject easement, and this District has no further
use for said portion,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer District
hereby vacates any rights, title, or interest of the District in the portion of
the thirty-foot (30') wide Drainage Easement, located in Lot 7, of "Ballas
Hills Ranch" a subdivision according to the plat thereof as recorded in
Plat Book 68, Page 33 of the St. Louis County Records, EXCEPTING
THEREFROM the thirty-foot (30') wide Drainage Easement recorded in
Deed Book 4786, Page 28, the ten-foot (10') wide easement recorded in
Deed Book 5012, Page 233, the five-foot (5') wide and irregular shape
easement recorded in Deed Book 7755, Page 613, the triangular
easement recorded in Deed Book 11285, Page 2431, and the ten-foot
(10') wide easement recorded in Plat Book 68, Page 33 of the St. Louis
County Records, in the City of Des Peres, St. Louis County, Missouri.
The foregoing Ordinance was adopted January 8, 2004.
