AN ORDINANCE, vacating any right, title or interest of the
District in three (3) portions of a ten-foot (10') wide easement recorded in
Plat Book 169, Pages 8 and 9 of the St. Louis County Records, said
easement being in Tract A-4 of "Oakville Shopping Center Amended", a
subdivision according to the plat thereof as recorded in Plat Book 172,
Pages 4 and 5 of the St. Louis County Records, in St. Louis County,
Missouri.
WHEREAS, the owner of the subject has requested this
District to vacate any right, title or interest that the District may have in
the portions of the subject easement, and this District has no further use
for said portions.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer District
hereby vacates any right, title, or interest that it may have in the three
(3) portions of the ten-foot (10') wide easement as shown hachured on the
attached "Easement Vacation Plat" and marked Exhibit "A" and made a
part hereof, EXCEPTING THEREFORM, existing easements recorded in
Deed Book 12435, pages 1729 through 1734 of the St. Louis County
Records and the thirty-foot (30') wide and the twenty-two foot (22') wide
road/utility easement recorded in Plat Book 169, Pages 8 and 9 of the St.
Louis County Records, in St. Louis County, Missouri.
The foregoing Ordinance was adopted March 11, 2004.
