AN ORDINANCE, vacating any right, title or interest of the
District in a portion of a ten-foot (10') wide easement recorded in Deed
book 5051, Page 590 and in Deed Book 5051, Page 593 and vacating a
portion of a ten-foot (10') wide easement recorded in Deed Book 6275,
Page 1169 of the St. Louis County Records, said easements being in
"Pelican Cove", a subdivision according to the plat thereof as recorded in
Plat Book 258, Pages 81 through 83 of the St. Louis County Records, in
the City of Florissant, St. Louis County, Missouri.
WHEREAS, the owner of the subject property has requested
that this District vacate any right, title or interest that the District may
have in the portions of the subject easements, and this District has no
further use for said portions,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer District
hereby vacates any right, title, or interest that it may have in the portion
of the ten-foot (10') wide easement recorded in Deed Book 5051, Page
590 in Deed Book 5051, Page 593 and vacating a portion of a ten-foot
(10') wide easement recorded in Deed Book 6275, Page 1169 of the St.
Louis County Records as shown hachured on the attached "Easement
Vacation Plat" and marked Exhibit "A" and made a part hereof,
EXCEPTING THEREFROM, the ten-foot (10') wide easement recorded in
Deed Book 6632, Page 353, the ten-foot (10') wide easement recorded in
Deed Book 7086, Page 125, and the easements established by the plat of
"Pelican Cove", as recorded in Plat Book 258, Pages 81 through 83 of the
St. Louis County Records.
The foregoing Ordinance was adopted April 22, 2004.
