HomeMy Public PortalAbout11925O R D I N A N C E NO. 11925 AN ORDINANCE, authorizing the Executive Director and Secretary-
Treasurer on behalf of The Metropolitan St. Louis Sewer District to execute a
Release Instrument to an Agreement for Sanitary Sewer Treatment or Disposal as
entered into on July 20, 1972, by and between Borg-Warner Corporation and St.
Louis County Sewer Company.
WHEREAS, The Metropolitan St. Louis Sewer District is the successor
in title and interest to St. Louis County Sewer Company, and
WHEREAS, the aforesaid Agreement for Sanitary Sewer Treatment or
Disposal has been superseded by District ordinances and regulations, and bears no
relevance to District operations; but however, remains an encumbrance as recorded
against the title of the real property in question, and
WHEREAS, the owner of said real property has requested that the
District, as successor in title and interest to St. Louis County Sewer Company,
release said encumbrance of title,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Secretary-Treasurer are
hereby authorized on behalf of The Metropolitan St. Louis Sewer District to execute
a Release Instrument to an Agreement for Sanitary Sewer Treatment or Disposal as
entered into on July 20, 1972, by and between Borg-Warner Corporation and St.
Louis County Sewer Company.
Section Two. The Release Instrument as authorized in Section One of this
ordinance shall be comprised of such terms and conditions as are approved by the
office of the General Counsel of the District.
The foregoing Ordinance was adopted January 13, 2005.
