WHEREAS, Colliers Engineering & Design, 101 Crawfords Corner Road, Suite 3400, Holmdel, New Jersey 07733, possesses the requisite experience and expertise to provide said services; and WHEREAS, Colliers Engineering & Design has submitted a proposal to provide said services at a total cost not to exceed $35,710.00; and WHEREAS, the Mayor and the Council have reviewed said proposal; and WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said purpose. Aect. # NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the Borough Of Carteret, County of Middlesex, State of New Jersey, as follows: 1. The proposal from Colliers Engineering & Design for engineering services with regard to additional Professional Services with regard to the NJDEP ONRR Grant River Walk Phase IIC -Northern Section at a cost not to exceed $35,710.00 is hereby approved. 2. This action is approved as an award of a professional services contract pursuant to N.J.&A 40A:11-5(1)(a) in accordance with the Borough's Fair and Open Process as authorized bylaw. 3. A copy of this Resolution be forwarded to the Borough's Finance Department, the Borough Director of Engineering and Colliers Engineering & Design, Adopted this 28' day of December, 2023 and certified as a true copy of the original on December 29, 2023. Reiman, Mayor Borough of Carteret Memorial Municipal Building 61 Cooke Avenue Carteret, NJ 07708 Proposal for Additional Professional Services NJDEP ORR Grant River Walk Phase IIC - Northern Section Borough of Carteret, Middlesex County, New Jersey Colliers Engineering & Design Proposal No.: 17001048P Dear Mayor Reiman, Engineering & Design Colliers Engineering & Design, Inc. (DBA Maser Consulting) is pleased to submit this proposal to provide additional Professional Engineering services for the continued development of the Northern walkway located at the Carteret Waterfront Park. The project scope includes the revisions to the currently approved River Walk alignment for Phase IIC. This proposal is divided into four sections as follows: Section I - Scope of Services Section II - Business Terms and Conditions Section III - Technical Staff Hourly Rate Schedule and Reimbursable Expenses Section IV - Client Contract Authorization The order in which the following scope of services are presented generally follows the sequence in which the project will be accomplished; however, depending on the project, the various authorized services contained in this proposal may be performed in a sequence as deemed appropriate by Colliers Engineering & Design ICED) to meet project schedules. Section I - Scope of Services Based on our conversations and information noted above, we propose to complete the following: PHASE 1,0 ADDITIONAL ENGINEERING DESIGN & PERMIT DOCUMENTS The original permit plans were for the entire 2,400-foot project length of the boardwalk. Subsequently, the project was broken into three (3) phases. Phase IIA is the middle portion of the project with a length of approximately 1,150. Phase 1113 connects the southern end of Phase IIA to the Engineering & Design adjacent park with a length of approximately 550 feet and fronts on the ferry terminal parcel. The remainder is Phase IIC which traverses the Basin Holding property connecting the improvements to Roosevelt Avenue and is approximately 600 feet. The permit plans for Phase IIC were not developed into construction plans as the Borough did not have access to the parcel at that time. The permit plans will be revised to address the Borough's direction to accomplish the following: ® Redesign horizontal and vertical alignment of Phase IIC of the boardwalk and extend it westerly toward Roosevelt Avenue. The profile will be adjusted to provide the proper clearances. Provide two piers, where shown in previous concepts, off the Basin Holding parcel, and widen them to 20' width and extended piers to pier headline. Dolphin Piling will be provided for the anticipated floating barges/vessels. Develop urban beach concept design upland of Phase IIA. Beach limits and preliminary grading will be provided. Phase 1.0 Lump Sum Fee PHASE 2.0 ADDITIONAL PERMITTING SERVICES $21,360.00 CED previously secured an Upland Waterfront Development Permitfrom the NJDEP for the installation of the entire boardwalk on this project site. The Borough has requested that CED apply for an extension to the original NJ DES permit. Subsequently, there were revisions to the alignment in Phase IIB that triggered additional/amendments to the previously obtained permits. These permits have been obtained. The Borough is now proposing to revise the alignment and extend Phase IIC of the boardwalk and seek approval for two piers. 2.1 NJDEP Upland Waterfront Development Permit Extension Request - Riverwalk The Borough of Carteret was issued an Individual Permit for Waterfront Development by NJDEP on August 8, 2019. The Borough is concerned that the phasing of the project may present an issue if the last phase is not started before the August 7, 2024 deadline. CED will submit a permit extension request on behalf of the Borough along with the limited required backup documentation. Task 2.1 Lump Sum Fee $1,950.00 2.2 NJDEP Upland Waterfront Development Permit Modification The proposed activitieswill require a major technical modification to the existing permits from the NJDEP DLRP. CED will prepare an application request for the appropriate permit modification from the NJDEP in accordance with the standards described in subchapters 3, 5, 6 and 10 of the Coastal Zone Management Rules. Task 2.2 Lump Sum Fee $3,750.00 Proposal No. 17001048P Deceinber 26, 2023 Page 2 1 5 Engineering & Design 2.3 U.S. Army Corps of Engineers Permit Application CED will prepare an application for an Individual Section 10 permit in accordance with USACE standards, This will include a written description of the project that covers the project features and activities and proposed construction methods in detail, information regarding the types of structures to be constructed, the materials the structures will be built from, and the structures' effects on navigability of the waterway. This application will include maps of the project site showing the project site with a clear project boundary relative to a USGS topographic quadrangle or aerial photograph, including landmark information like street names or other features to identify the location as well as completion of U.S. Army Engineering Form 4345. Task 2.3 Lump Sum Fee $3,900.00 Phase 2.0 Lump Sum Fee $9,600.00 PHASE 3.0 EASEMENT METES AND BOUNDS DESCRIPTION Colliers Engineering & Design will prepare one (1) individual property exhibit map and one (1) metes & bounds description for a Boardwalk Easement running through a portion of Outparcel 'A' and Outparcel 'B' said parcels as shown on a map entitled, "Existing Conditions, Former Agrico Site, Carteret, New Jersey" dated and revised July 2018, prepared by Geosyntec. The easement layout will follow the Boardwalk alignment as depicted on a map entitled, "Waterfront Development Permit Modification Plan for NJDEP ONRR Grant River Walk, Phase II B - Northern Section, Carteret Waterfront Park, Borough of Carteret, Middlesex County, New Jersey, Sheet 2 of 2, dated October 10, 2022, prepared by Colliers Engineering & Design. This exhibit map will be based on Deed Book 6218 Page 752 for Outparcel'A' and research will be performed to acquire the original survey prepared by Blue Marsh Associates dated March 10, 2011. Phase 3.0 Lump Sum Fee REIMBURSABLE EXPENSES $3,250.00 Delivery, printing and reproduction, overnight mail service, certified mail service and postage costs are not included in the Phases above and will be added to each monthly invoice. Our office recommends the following budget. Exch-is€ons and Understandings Services relating to the following items are not anticipated for the project or cannot be quantified at this time. Therefore, any service associated with the following items is specifically excluded from the scope of professional services within this agreement. • Services not specifically outlined in Section I; • Permit Application Fees; • Wetland Delineation; • Environmental Remediation Services; and, Exploratory or testing work, interpretations or conclusions related to determination of potential chemical, toxic, radioactive or other type of contaminants on the site. If an item not listed herein, or otherwise not specifically mentioned within this agreement, is deemed necessary, CED may prepare an addendum to this agreement for your review outlining the scope of additional services and associated professional fees regarding the extra services. Section II - Business Terms and Conditions The Business Terms and Conditions are on file with the Borough.
