AN ORDINANCE, authorizing the Executive Director and Secretary-
Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into a
contract with Camp Dresser & McKee, Inc. (CDM), whereby Camp Dresser &
McKee, Inc. (CDM) will provide rate expert testimony services required during
anticipated future Rate Commission Hearings, with an emergency clause.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Secretary-Treasurer are
hereby authorized on behalf of The Metropolitan St. Louis Sewer District to enter
into a contract with Camp Dresser & McKee, Inc. (CDM), whereby Camp Dresser &
McKee, Inc. (CDM) will provide rate expert testimony services required during
anticipated future Rate Commission Hearings.
Section Two. The contract authorized in Section One of this ordinance
shall provide for a fee not to exceed One Hundred Fifty-two Thousand Five Hundred
Seventy-six Dollars ($152,576.00), for fiscal year 2005, and Forty-one Thousand Six
Hundred Eighty-eight Dollars ($41,688.00) for fiscal year 2006, and shall be
comprised of such other terms and conditions as are approved by the office of the
General Counsel of the District.
Section Three. The expert testimony services as hereinabove
authorized are vital to the implementation of proposed wastewater user rates
pursuant to the Rate Commission procedures, and must be provided for without
delay, thus creating an emergency within the meaning of the Charter. Accordingly,
this ordinance shall take effect immediately upon it enactment.
The foregoing Ordinance was adopted February 10, 2005.
