five Thousand Dollars ($1,575,000.00) from the Caulks Creek Construction Fund to
reimburse THF Chesterfield Two Development (L.L.C.) for project costs for the
construction of sanitary sewers in Infrastructure Repair #087P Caulks Creek "A"
(P-750) Phase IV, Section A (93077C), in the City of Chesterfield, Missouri; and
authorizing the Executive Director and Secretary-Treasurer on behalf of The
Metropolitan St. Louis Sewer District to enter into a contract with THF
Chesterfield Two Development (L.L.C.) for the reimbursement of said construction
costs.
WHEREAS, THF Chesterfield Two Development (L.L.C.) has
undertaken the construction of said sanitary sewers, and the District has agreed to
reimburse THF Chesterfield Two Development (L.L.C.) for the project costs of said
construction, and
WHEREAS, the Director of Finance has certified that there is an
unencumbered balance in the above-named fund sufficient to pay the obligation
authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of One Million Five Hundred Seventy-five
Thousand Dollars ($1,575,000.00) is hereby appropriated from the Caulks Creek
Construction Fund to reimburse THF Chesterfield Two Development (L.L.C.) for
project costs for the construction of sanitary sewers in Infrastructure Repair #087P
Caulks Creek "A" (P-750) Phase IV, Section A (93077C), in the City of Chesterfield,
Missouri.
Section Two. The Executive Director and Secretary-Treasurer are
hereby authorized on behalf of The Metropolitan St. Louis Sewer District to enter
into a contract with THF Chesterfield Two Development (L.L.C.) whereby the
District will reimburse THF Chesterfield Two Development (L.L.C.) for project costs
for the construction of sanitary sewers in Infrastructure Repair #087P Caulks Creek
"A" (P-750) Phase IV, Section A (93077C), in the City of Chesterfield, Missouri.
Section Three. The contract authorized in Section Two of this
ordinance shall be comprised of such terms and conditions as are approved by the
office of the General Counsel of the District.
Section Four. This ordinance, being an appropriation ordinance, shall
take effect immediately upon its enactment.
The foregoing Ordinance was adopted April 14, 2005.
