HomeMy Public PortalAbout11983O R D I N A N C E NO. 11983 AN ORDINANCE, authorizing the Executive Director and Secretary- Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into an Intergovernmental Agreement with the City of Arnold, Missouri, whereby the District will allow the City of Arnold, Missouri a second drop shaft (connection point) to the Baumgartner Tunnel as part of the District's Lower Meramec River System Improvements. WHEREAS, the Plan of The Metropolitan St. Louis Sewer District empowers the District to contract with municipalities, districts, other public agencies, individuals, or private corporations, or any of them whether within or without the District, for the construction, use, or maintenance of common or joint sewers, drains, outlets, or disposal plants, or for the performance of any service required by the District; and for the connection with and use of the facilities of the District, and WHEREAS, the District, pursuant to its authorities and powers, is the lead applicant for Federal and State water pollution control grant assistance in the Lower Meramec River Basin comprising nine (9) major watersheds in St. Louis County, Missouri and four (4) major watersheds in Jefferson County, Missouri and concomitantly therewith, has developed a regional sewerage system facility plan for the entire Lower Meramec River Basin watershed; and has agreed to perform the aforesaid sewerage treatment services for said City of Arnold, Missouri, and WHEREAS, through Ordinance No. 4655, adopted March 3, 1982, the District entered into an Intergovernmental Agreement with the City of Arnold, Missouri whereby the District will accept and treat sewerage generated within the sewer system boundaries of said City, and WHEREAS, said Intergovernmental Agreement permitted the City of Arnold, Missouri only one drop shaft (connection point) to District facilities, and WHEREAS, the City of Arnold, Missouri has requested a second drop shaft (connection point) to the District facilities known as the Baumgartner Tunnel, and said City is willing to reimburse the District for all costs associated with said second drop shaft (connection point), NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and Secretary-Treasurer are hereby authorized on behalf of The Metropolitan St. Louis Sewer District to enter into an Intergovernmental Agreement with the City of Arnold, Missouri, whereby the District will allow the City of Arnold, Missouri a second drop shaft (connection point) to the Baumgartner Tunnel as part of the District's Lower Meramec River System Improvements. Section Two. The Intergovernmental Agreement authorized in Section One of this ordinance shall be comprised of such terms and conditions as are approved by the office of the General Counsel of the District. The foregoing Ordinance was adopted May 5, 2005.
