HomeMy Public PortalAboutOrd. 23-25No. #23-25 .A.f t4.e vlroq4 .af Tart- aef, � JM AMENDING AND SUPPLEMENTING CHAPTER 16o ENTITLED LAND DEVELOPMENT Be it ordained by the Mayor and Council of the Borough of Carteret as follows: Section 1. § 160-137. HI-B Heavy Industrial Zone regulations is hereby deleted in its entirety and replaced with the "Suggested Use Modifications for HI-B" set forth on the attached Schedule A, which sball be made a part hereof as if set forth at length herein. Section 2. The Bulls Schedule set forth at the end of Chapter 160 entitled 160 Attachment I shall be amended and supplemented to reflect the respective changes to the listings for R-50, &25, HI -A and HI-B Zones as set forth on the Bulk Standards Grids contained on the attached Schedules A and B, which shall be made a part hereof as if set forth at length herein, Section 3. All ordinances ha d/or provisions thereof inconsistent with the provision of this ordinance shall be and are hereby repealed as to the extent of any such inconsistencies. Section 3. If any section, subsection, part, clause or phrase of this ordinance shall be declared invalid by judgment of any Court of competent jurisdiction, the section, subsection, part, clause or phrase shall be deemed to be severable from the remainder of this ordinance. Permitted principal uses shall be as follows: 1. All principal permitted in the Light Industrial Zone. 2. Data Centers 3. Flex -space with no more than 20% office related to the activity B. Permitted accessory uses shall be as follows: 1. All accessory uses or buildings, the purpose of which is customarily incidental and subordinate to that of the principal uses permitted in this district, such as but not limited to: (a) Off-street parking, loading and ramp areas and railroad sidings and facilities. (b) The warehousing and storage of goods and products which are used or produced on the premises. All goods and products shall be stored within an enclosed area. All trucks and vehicles stored on the premises shall be located within a rear yard and screened from view. Vehicles stored on the premises shall be located within the ,rear yard and screened from view. (c) Garage space necessary to store any vehicles on the premises. (d) Marine bulkheads, piers and docks, subject to the receipt of all necessary federal, state, and local approvals. (e) Underground and aboveground space heating oil tanks for use and consumption on site, subject to receipt of all necessary federal and state approvals. (f) Roof -mounting photovoltaic systems. (g) Emergency generators (h) Food service preparation and dispersal as an accessory to a principal use provided the area devoted to the food service use does not exceed 5% of the gross floor area. C. Bulk requirements shall be specified in the Bulk Schedule attached to and made a part of this chapter (2) for the I-B Zone. D. Permitted signs: see § 160-113. E. Parking: see § 160-107 F. Prohibited uses shall be as follows: 1. All natural and synthetic gas production, transfer, processing or distribution. 2. Paint exterior wall signs. 3. Junkyard and garbage dumps 4. Outdoor storage of goods or inventory 5. All tanks, except as otherwise noted in this article. 6. Refining and processing of any gasoline, crude oil, or the manufacture of bottled fuel gas or any of the principal products or by-products of the petrochemical industry. 7. The sale, rental or leasing of any used car, truck, or vehicle except as an accessory to a permitted use. 8. Boardinghouses and rooming houses. 9. Any uses and manufacturing that create substantial noise, vibration, smoke, dust, odors, heat, glare, or other objectionable influences, and create a danger to the safety of the surrounding area. 10.The slaughter of animals and rendering of fats and oils. 11.Any use which may be toxic, lethal, hazardous or injurious to the general health, safety and welfare of the general public.
