HomeMy Public PortalAbout12009O R D I N A N C E NO. 12009 AN ORDINANCE, authorizing the Executive Director and Secretary- Treasurer on behalf of The Metropolitan St. Louis Sewer District to execute an instrument conveying easement rights across certain real property of the District in the City of Maryland Heights, Missouri known as the Missouri River Wastewater Treatment Plant site to the Metropolitan Parks and Recreation District d/b/a Great Rivers Greenway District, for the construction and maintenance of a bicycle and walking trail thereon. WHEREAS, the Howard Bend Levee District currently possesses certain easement rights upon said District real property, and will execute said instrument in conjunction with the District, and WHEREAS, the conveyance of said easement rights will not interfere with the District's operations on the aforesaid real property. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and Secretary-Treasurer are hereby authorized on behalf of The Metropolitan St. Louis Sewer District to execute an instrument conveying easement rights across certain real property of the District in the City of Maryland Heights, Missouri known as the Missouri River Wastewater Treatment plant site to the Metropolitan Parks and recreation District d/b/a Great River Greenway District for the construction and maintenance of a bicycle and walking trail thereon, said easement rights upon the real property described as follows: Part of a tract of land conveyed to The Metropolitan St. Louis Sewer District recorded in Deed Book 7021, Page 1099 of the St. Louis County Records being part of the accretions to Lot 16 of the L.C. Smith Partition recorded in Book X6, Page 320 of the St. Louis City (former county) records in U.S. Survey 2040, Township 46 North, Range 5 East, of the Fifth Principal Meridian, being more particularly described as follows: Beginning at a point on the southwest line of U.S. Survey 2040 from which the most eastern corner of Lot 1 of Samuel Bonner's Subdivision of Creve Coeur Lake Place recorded in Plat Book 2, Page 23 of the St. Louis County Records bears South 23 degrees 38 minutes 39 seconds East, 2765.34 feet; thence along said southwest line North 23 degrees 38 minutes 39 seconds West, 250.35 feet; thence leaving said southwest line North 69 degrees 24 minutes 23 East, 151.66 feet to the beginning of a tangential curve; thence along said curve to the left having a radius of 75.00 feet, an arc length of 50.00, a chord bearing of North 50 degrees 18 minutes 30 seconds East, and a chord length of 49.08 feet; thence leaving said curve North 31 degrees 12 minutes 37 seconds East, 1285.50 feet to the beginning of a tangential curve; thence along said curve to the right having a radius of 325.00 feet, an arc length of 202.99 feet, a chord bearing North 49 degrees 06 minutes 13 seconds East, and a chord length of 199.71 feet to the northeast line of said tract conveyed to The Metropolitan St. Louis Sewer District; thence along said northeast line South 23 degrees 09 minutes 46 seconds East, 250.00 feet; thence leaving said northeast line South 67 degrees 02 minutes 23 seconds West, 24.89 feet; thence South 31 degrees 12 minutes 37 seconds West, 1309.74 feet to the beginning of a tangential curve; thence along said curve to the right having a radius of 325.00 feet, an arc length of 216.66 feet, a chord bearing of South 50 degrees 18 minutes 30 seconds East, and a chord length of 212.67 feet; thence South 69 degrees 24 minutes 23 seconds West, 138.34 feet to the point of beginning and the above described easement being composed of 10 acres more or less. Section Two. The easement instrument as authorized in Section One of this ordinance shall be comprised of such terms and conditions as are approved by the office of the General Counsel of the District. The foregoing Ordinance was adopted June 9, 2005.
