HomeMy Public PortalAbout12014O R D I N A N C E NO. 12014 AN ORDINANCE, declaring the necessity for the acquisition of real property and/or easements within The Metropolitan St. Louis Sewer District for treatment plant improvements in the project known as Grand Glaize WWTP Improvements (2003061) to serve the needs of the entire Grand Glaize Service Area, and authorizing the acquisition of real property and/or easements by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of the County of St. Louis within the Grand Glaize Watershed wherein live and work numerous people; and WHEREAS, sanitary and storm sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by the acquisition of said real property for treatment plant improvement purposes to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve in sanitary and dangerous conditions, it is necessary to appropriate and acquire 2 by the exercise of eminent domain or otherwise real property and/or easements in real property for treatment plant improvement purposes in the project known as Grand Glaize WWTP Improvements (2003061) hereinafter set forth, said real property and/or easements in real property being more particularly described as follows: A tract of land lying partly in the South ½ of Section 9 and partly in North½ Section 16, Township 44 North, Range 5 East, and described as: Beginning at the intersection of the South line of said Section 9 with the East line of a 74.907 acre tract conveyed to George W. Baumhoff by deed Recorded in Book 237 page 522 of the St. Louie County Records; thence North 0 degrees 09 minutes East 95.43 feet and North 69 degrees 51 minutes West 2268.85 feet to a point and this is the point of beginning and the Northeast corner of the tract of land hereinafter described; thence North 89 degrees 51 minutes West 462.00 feet, more or less, to a point in the West line of a tract of land conveyed to Urban A. Cartier and wife by deed recorded in Book 2735 Page 494 of said records; (said line being also the West line of section 9) thence along said Section line, South 0 degrees l2 minutes West to the corner common to Sections 8.9.16, and 17 of said Township and Range; thence along the West line of Section 16, South 1 degree 27 minutes West 480 feet, more or Less, to the Northwest corner of a tract of land conveyed to Valley Park Memorial Past Number 439 of the American Legion by deed recorded in Book 2548 Page 389 of said records; thence along the Northern line of said property and along the Northern 1ine of property conveyed to James T. Carr and wife by deed recorded in Book 2530 Page 258, as follows, South 88 degrees 20 minutes East 86.32 feet. North 52 degrees 16 minutes East 54.76 feet North 9 degrees 23 minutes East 235.18 feet, North 51 degrees 39 minutes East 90.85 feet, South 83 3 degree4 56 minutes East 108.34 feet and South 65 degrees 43 minutes East, 132.16f feet to a point; thence North 1 degree 40 minutes East 317.35 feet to the point of beginning. Locator No. 25P-61-0023 13466 Westerman Road St. Louis, MO 63122 _________________________________ A parcel of land in the South ½ of Section 9, Township 44 North, Range 5 East, being part of Lots 9 and 10 of the Subdivision by Commissioners of the PETER BREEN ESTATE, in St. Louie County. Missouri, the plat of which is recorded in Book 376 page 346 of the Records of the City (former County) of St. Louis, the beginning point of which is described as: Commencing at the intersection of the South line of said Section 9 with the East line of property conveyed to George W. Baumhoff by deed recorded in Book 237 page 522 of the St. Louis County Records; thence North 0 degrees 09 minutes East 95.43 feet to a point; thence North 89 degrees 51 minutes West 1758.00 feet to a point and this is the point of beginning and the Southeast corner of the parcel of land hereinafter described; thence North 89 degrees 51 minutes West 436.08 feet to a point; thence North 0 degrees 09 minutes East 600.00 feet to a point; thence South 89 degrees 51 minutes East 436.08 feet to a point; thence South 0 degrees 09 minutes West 600.00 feet to the point of beginning. Locator No. 25P-61-0034 13405 Westerman Road St. Louis, MO 63122 Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase if possible, or to institute and prosecute an action in condemnation 4 pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinabove set out. The foregoing Ordinance was adopted June 9, 2005.
