HomeMy Public PortalAbout12032O R D I N A N C E NO. 12032 AN ORDINANCE, authorizing the Executive Director and Secretary-
Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into an
Intergovernmental Agreement with St. Louis County, Missouri (County), St. Louis
County Port Authority (Port Authority), the City of St. Louis, Missouri (City), and
Pinnacle Entertainment, Inc. (Pinnacle) for the construction of an access road by
Pinnacle from Lemay Ferry Road to the former NL Industries site, as owned by
Port Authority.
WHEREAS, the development and construction of the access road by
Pinnacle will benefit both the County and the City by providing (a) better public
safety access to local businesses; (b) the redevelopment of certain blighted
properties; (c) the extension of the Great Rivers Greenway recreation trail system;
and (d) access to improved park land owned by Port Authority; and
WHEREAS, the development and construction of the access road by
Pinnacle will benefit the parties by providing the District with the possibility of
expanding its property ownership for expansion of its Lemay Treatment Plant and
providing additional access to the District's Lemay Treatment Plant; and
WHEREAS, the access road, upon completion of construction, will
become a public road partially within the City of St. Louis and partially within St.
Louis County; and
WHEREAS, the County, the City and the Port Authority desire to form
a joint Tansportation Development District ("TDD") pursuant to Section 238.200
RSMo. for the purpose of funding, planning, designing and constructing the access
road; and
WHEREAS, the County is willing to maintain the access road upon its
completion in accordance with the terms of this Agreement and any agreement
entered into between the County and the TDD; and
WHEREAS, the District is willing to maintain the sewer, storm water,
sanitary, and drainage systems and any appurtenances thereto in connection with
the access road.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Secretary-Treasurer are
hereby authorized on behalf of The Metropolitan St. Louis Sewer District to enter
into an Intergovernmental Agreement with St. Louis County, Missouri (County), St.
Louis Port Authority (Port Authority), the City of St. Louis, Missouri (City), and
Pinnacle Entertainment, Inc. (Pinnacle) for the construction of an access road by
Pinnacle from Lemay Ferry Road to the former NL Industries site, as owned by the
Port Authority.
Section Two. The Intergovernmental Agreement as authorized in
Section One of this ordinance shall be comprised of such terms and conditions as are
approved by the office of the General Counsel of the District.
The foregoing Ordinance was adopted July 14, 2005.
