HomeMy Public PortalAbout12078 O R D I N A N C E NO. 12078 AN ORDINANCE, declaring the necessity for the acquisition of easements and licenses in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of storm and sanitary sewers and related appurtenances in the project known as Lorenzo Lane Storm Sewer (2001058) to serve the needs of residents of the area, and authorizing the acquisition of said easements and licenses by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of the County of St. Louis within the Black Creek Watershed wherein live and work numerous people; and WHEREAS, sanitary sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sanitary sewer lines and related appurtenances on, over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements and licenses in real property for the construction of storm and sanitary sewers and related appurtenances in the project known as Lorenzo Lane Storm Sewer (2001058) as hereinafter set forth, said easements and licenses being more particularly described as follows: Lorenzo Lane Storm Sewer M.S.D. Project No. 2001058 Parcel # 1(Miller Property) 18L-34-0157 Deed Book 7419, Page 1686 A 10 foot wide PERMANENT SEWER EASEMENT being part of Lot 6 of Morris Hezel Subdivision, a subdivision according to the plat thereof recorded in Plat Book 5, Page 19 of the St. Louis County, Missouri Recorder’s Office, the centerline of which is more particularly described as follows: Commencing at the southeast corner of Lot 1 of White Gate Lane, a subdivision according to the plat thereof recorded in Plat Book 46, Page 34 of the St. Louis County Records; THENCE along the north line of Ladue Road, 60 feet wide, South 89 degrees 42 minutes 00 seconds East a distance of 6.32 feet to the Actual Point Of Beginning of the centerline of said 10 foot wide Permanent Sewer Easement; THENCE leaving said north line of Ladue Road, and proceeding along said centerline the following courses and distances: North 20 degrees 46 minutes 06 seconds East a distance of 64.91 feet to a point; THENCE North 00 degrees 50 minutes 55 seconds East a distance of 198.04 feet to the Point Of Ending of the centerline of said 10 foot wide Permanent Sewer Easement, said point being on the south line of property conveyed to William P. Castle and Emily P. Castle by deed recorded in book 15053, page 474-476 of the St. Louis County Records, said point being distant along said south line, South 89 degrees 40 minutes 13 seconds East a distance of 30.13 feet from the east line of said Lot 1. Excepting that portion of the above described permanent sewer easement that lies in an existing 10 foot wide easement granted to The McKnight Village Sanitary Sewer District by deed recorded in book 1476, page 171 of the St. Louis County Records. Also, two PERMANENT WORKING ROOM EASEMENTS for use during the construction, reconstruction, maintenance or repair of any sewer in the above described permanent sewer easement, said permanent working room easements being more particularly described as follows: PERMANENT WORKING ROOM EASEMENT NO. 1 Commencing at the southeast corner of Lot 1 of White Gate Lane, a subdivision according to the plat thereof recorded in Plat Book 46, Page 34 of the St. Louis County Records; THENCE along the north line of Ladue Road, 60 feet wide, South 89 degrees 42 minutes 00 seconds East a distance of 10.00 feet to a point; thence North 00 degrees 28 minutes 30 seconds East a distance of 24.35 feet to the Actual Point Of Beginning of the PERMANENT WORKING ROOM EASEMENT; THENCE North 00 degrees 28 minutes 30 seconds East a distance of 234.51 feet to the south line of property conveyed to William P. Castle and Emily P. Castle by deed recorded in book 15053, page 474-476 of the St. Louis County Records; THENCE along the south line of said Castle property South 89 degrees 40 minutes 13 seconds East a distance of 15.13 feet to a point; THENCE leaving the south line of said Castle property South 00 degrees 50 minutes 55 seconds West 197.12 feet to a point; THENCE South 20 degrees 46 minutes 06 seconds West a distance of 39.91 feet to the Point Of Beginning. PERMANENT WORKING ROOM EASEMENT NO. 2 Commencing at the southeast corner of Lot 1 of White Gate Lane, a subdivision according to the plat thereof recorded in Plat Book 46, Page 34 of the St. Louis County Records; THENCE along the north line of Ladue Road, 60 feet wide, South 89 degrees 42 minutes 00 seconds East a distance of 11.66 feet to the Actual Point Of Beginning of the PERMANENT WORKING ROOM EASEMENT; THENCE North 20 degrees 46 minutes 06 seconds East a distance of 63.92 feet to a point; THENCE North 00 degrees 50 minutes 55 seconds East a distance of 198.97 feet to the south line of property conveyed to William P. Castle and Emily P. Castle by deed recorded in book 15053, page 474-476 of the St. Louis County Records; THENCE along the south line of said Castle property South 89 degrees 40 minutes 13 seconds East a distance of 10.00 feet to a point; THENCE leaving the south line of said Castle property South 00 degrees 50 minutes 55 seconds West 200.81 feet to a point; THENCE South 20 degrees 46 minutes 06 seconds West a distance of 61.94 feet to said North right of way line of Ladue Road, 60 feet wide; THENCE Westwardly along said North right of way line of Ladue Road, 60 feet wide, North 89 degrees 42 minutes 00 seconds West a distance of 10.67 feet to the Point Of Beginning. Lorenzo Lane Storm Sewer M.S.D. Project No. 2001058 Parcel #2(Castle Property) 18L-34-0289 Deed Book 15053, Page 474-476 A 10 foot wide PERMANENT SEWER EASEMENT being part of Lot B of Lorenzo Acres, a subdivision according to the plat thereof recorded in Plat Book 124, Page 87 of the St. Louis County, Missouri Recorder’s Office, the centerline of which is more particularly described as follows: Commencing at the southwest corner of said Lot B; THENCE along the south line of said Lot B South 89 degrees 40 minutes 13 seconds East a distance of 30.13 feet to the Actual Point Of Beginning of the centerline of said 10 foot wide Permanent Sewer Easement; THENCE leaving said south line of Lot B, and proceeding along said centerline the following courses and distances: North 00 degrees 50 minutes 55 seconds East a distance of 23.88 feet to a point; THENCE North 00 degrees 07 minutes 28 seconds East a distance of 34.97 feet to a point; THENCE North 19 degrees 57 minutes 16 seconds West a distance of 86.14 feet to the Point Of Ending of the centerline of said 10 foot wide Permanent Sewer Easement, said point being on the west line of the aforesaid Lot B, and also being distant along said west line of Lot B, South 00 degrees 28 minutes 30 seconds East a distance of 13.59 feet from the northwest corner of said Lot B. Also, Commencing at the southwest corner of said Lot B; THENCE along the south line of said Lot B South 89 degrees 40 minutes 13 seconds East a distance of 30.13 feet to a point; THENCE leaving said south line of Lot B, North 00 degrees 50 minutes 55 seconds East a distance of 23.88 feet to the Actual Point Of Beginning of the centerline of said 10 foot wide Permanent Sewer Easement; THENCE North 89 degrees 56 minutes 10 seconds East a distance of 30.28 feet to the Point Of Ending of the centerline of said 10 foot wide Permanent Sewer Easement, said point being on the west line of the aforesaid Lot B, and also being distant along said west line of Lot B, North 00 degrees 28 minutes 30 seconds West a distance of 23.67 feet from the southwest corner of said Lot B. Excepting that portion of the above described permanent sewer easement that lies in an existing 10 foot wide easement granted to The McKnight Village Sanitary Sewer District by deed recorded in book 1431, page 73 of the St. Louis County Records. Also, three PERMANENT WORKING ROOM EASEMENTS for use during the construction, reconstruction, maintenance or repair of any sewer in the above described permanent sewer easement, said permanent working room easements being more particularly described as follows: PERMANENT WORKING ROOM EASEMENT NO. 1 Commencing at the southwest corner of the aforementioned Lot B; THENCE along the south line of said Lot B South 89 degrees 40 minutes 13 seconds East a distance of 10.00 feet to a point; THENCE leaving said south line of Lot B North 00 degrees 28 minutes 30 seconds East 28.74 feet to the Actual Point Of Beginning of the PERMANENT WORKING ROOM EASEMENT herein described: THENCE North 00 degrees 28 minutes 30 seconds East, a distance of 69.72 feet to a point: THENCE South 19 degrees 57 minutes 16 seconds East, a distance of 43.19 feet to a point; THENCE South 00 degrees 07 minutes 28 seconds West, a distance of 29.10 feet to a point; THENCE North 89 degrees 56 minutes 10 seconds East, a distance of 15.25 feet to the Point Of Beginning. PERMANENT WORKING ROOM EASEMENT NO. 2 Commencing at the southwest corner of the aforementioned Lot B; THENCE along the south line of said Lot B South 89 degrees 40 minutes 13 seconds East a distance of 35.13 feet to the Actual Point Of Beginning of the Permanent Working Room Easement herein described: THENCE leaving said south line of Lot B North 00 degrees 50 minutes 55 seconds East a distance of 23.90 feet to a point: THENCE North 00 degrees 07 minutes 28 seconds East a distance of 35.86 feet to a point; THENCE North 19 degrees 57 minutes 16 seconds West a distance of 71.80 feet to a point on the East line of an existing 10 foot wide easement granted to The McKnight Village Sanitary Sewer District by deed recorded in book 1431, page 73 of the St. Louis County Records; THENCE along said East line North 00 degrees 28 minutes 30 seconds East a distance of 26.14 feet to the North line of the aforementioned Lot B; THENCE eastwardly along said north line of Lot B South 89 degrees 40 minutes 13 seconds East a distance of 0.93 feet to a point; THENCE leaving said north line of Lot B South 19 degrees 57 minutes 16 seconds East a distance of 97.75 feet to a point; THENCE South 00 degrees 07 minutes 28 seconds West 37.63 feet to a point; THENCE South 00 degrees 50 minutes 55 seconds West 23.94 feet to the aforesaid South line of Lot B; THENCE along said south line of Lot B North 89 degrees 40 minutes 13 seconds West 10.00 feet to the Point Of Beginning. PERMANENT WORKING ROOM EASEMENT NO. 3 Commencing at the southwest corner of the aforementioned Lot B; THENCE along the south line of said Lot B South 89 degrees 40 minutes 13 seconds East a distance of 10.00 feet to the Actual Point Of Beginning of the PERMANENT WORKING ROOM EASEMENT herein described: THENCE North 00 degrees 28 minutes 30 seconds East, a distance of 18.74 feet to a point: THENCE South 89 degrees 56 minutes 10 seconds West, a distance of 15.25 feet to a point; THENCE South 00 degrees 50 minutes 55 seconds West, a distance of 18.85 feet to the aforesaid South line of Lot B; THENCE along said south line of Lot B North 89 degrees 40 minutes 13 seconds West, a distance of 15.13 feet to the Point Of Beginning. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase if possible, or to institute and prosecute an action in condemnation pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property rights as hereinabove set out. The foregoing Ordinance was adopted September 8, 2005.
