HomeMy Public PortalAbout2005-079 (05-17-05)RESOLUTION NO. ?fin~_n7q A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ORDERING THE VACATION AND ABANDONMENT OF THE ALLEY LOCATED NORTH OF JOSEPHINE STREET BETWEEN THIRD AVENUE AND FOURTH AVENUE WHEREAS, the City Council of the City of Lynwood did, on the 19th day of April, 2005, adopted Resolution No. 2005-064, declaring its intention to vacate that portion of the alley located north of Josephine Street between Third Avenue and Fourth Avenue; and WHEREAS, notices of said vacation have been publicized in the time, form, and manner required by law; and WHEREAS, a public hearing on the matter was held on the 17th day of May, 2005, as prescribed by law; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lynwood as follows: Section 1. That the following described portion of alley is unnecessary for present or prospective public use, and that the public interest, necessity and convenience require that the City Council of said City hereby order the vacation and abandonment of a portion of said alley, as described as follows: That portion of the alley located in the City of Lynwood, County of Los Angeles, State of California, bounded to the north by Caltrans southerly right-of-way line of the 1-105 Freeway easement and to the south by the northerly right-of-way line of Josephine Street, as shown on map of Tract No. 8716, as per Map recorded in Book 145, Pages 63 and 64 of Maps, in the office of the County Recorder of said County. Section 2. That the City Council of the City of Lynwood does hereby determine that the public convenience and necessity require that necessary easements be retained for ingress and egress to private and publicly owned facilities and for the construction and maintenance of utilities within the limits of said portion of the alley as described in Section 1. Said easements shall include but are not limited to the following: 1. An Easement reserved for the City of Lynwood for the operation and maintenance of the municipal sewer line facilities. Section 3. That the City Clerk of the City of Lynwood shall cause a certified copy of said order to be recorded in the office of the Recorder of Los Angeles County. Section 4.
