AN ORDINANCE OF THE CITY OF TEMPLE
CITY SUSPENDING ORDINANCE NO. 66 -198
AND ENACTING AN INTERIM ZONING ORD-
INANCE, PURSUANT TO THE 'ROVISIONS• •
OF SECTION 65858 OF THE CALIFORNIA
GOVERNMENT CODE, RELATING TO THE
CONSTRUCTION OF KENNELS, ANIMAL
HOSPITALS, VETERINARY CLINICS AND
OFFICES.
TEE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES
ORDAIN:
SECTION 1. The City Council does hereby find and deter-
mine that the Planning Commission of this City has heretofore
undertaken studies to determine the appropriate zone classification
for kennels, animal hospitals, veterinary clinics and offices, and
to ascertain whether a Special or Conditional Use Permit should be
required as a prerequisite to construction thereof in order to
prescribe necessary conditions to safeguard against traffic hazards
and devaluation of neighboring residential properties;. that said
Planning Commission has heretofore adopted a Resolution making .
certain recommendations in connection therewith; and that this
City Council, after public hearing thereon, has concurred in such
recommendation for inclusion in the new zoning code now in process
of preparation.
SECTION 2. The City Council further finds that the
processing of the new zoning code including such recommendations
is contemplated by the Planning Commission and City Council
within the next few months, and that to permit further construction
of kennels, animal hospitals, veterinary clinics and offices prior
to the consummation of the appropriate hearings thereon would in
large measure emasculate the benefits to be derived therefrom and
would be contrary to the best interests and general welfare of the
residents of this City.
SECTION 3. Pending completion of such revised zoning
code and review thereof, and pursuant to the provisions of Section
65858 of the Government Code, a prerequisite Conditional Use Permit,
processed and issued pursuant to the existing zoning code, is here-
by imposed upon the construction, and issuance of building permits
for the construction and substantial reconstruction, of kennels,
animal hospitals, veterinary clinics and offices in the City.
SECTION 4. The provisions of the Temple City Municipal
Code authorizing the construction of such kennels, animal hospitals,
veterinary clinics and offices without such Conditional Use Permit
are hereby suspended.
SECTION 5. This Ordinance shall remain in effect until
November 16, 1966, and the Building Inspector of this City is
directed not to issue any building permit for a kennel, animal
hospital, veterinary clinic or office construction or substantial
reconstruction during the term cf this Ordinance, except in com-
pliance with a Conditional Use Permit first issued therefor.
SECTION 6. This Ordinance shall become immediately
effective pursuant to the provisions of Section 65858 of the
Government Code and for the reasona above stated, and is adopted
pursuant to the authority of Anderson v. Pleasant Hills, 229 A.C.A.
81; Metro Realt v. Count o E Dora o, A.C.A. 5O; Hunter
v. Adams, C.A. ; Los Angeles vv. Superior Court, 27FAC.7A.

SECTION 6. Ordinance No. 66 =198 is superseded hereby.
SECTION 7. The City Clerk of the City of Temple City
shall certify to the passage and adoption of this Ordinance and
to its approval by the Mayor and shall cause the same to be
published in the Temple City Times, a newspaper of general
circulation, printed, published and circulated in the City of
Temple City.
