HomeMy Public PortalAbout12280O R D I N A N C E NO. 12280 AN ORDINANCE, appropriating Two Hundred Thousand Dollars ($200,000.00) from the Operation, Maintenance and Construction Improvement Fund of the Lower Meramec River Basin to reimburse American Heritage Homes, L.L.C. for the costs of construction of sanitary sewers as undertaken by American Heritage Homes, L.L.C. in Williams Creek Sanitary Interceptor Phase IIB (2000046B) in St. Louis County, Missouri; and authorizing the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into a contract with American Heritage Homes, L.L.C. whereby the District will reimburse American Heritage Homes, L.L.C. for the construction of said sanitary sewers. WHEREAS, American Heritage Homes, L.L.C. has undertaken the construction of said sanitary sewers on the District’s behalf, and WHEREAS, the District is willing to reimburse American Heritage Homes, L.L.C. for the costs of said sanitary sewers, and WHEREAS, the Director of Finance has certified that there is an unencumbered balance in the above-named fund sufficient to pay the obligation authorized herein, NOW, THEREFORE BE IT ORDAINED BY THE BOARD TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One The sum of Two Hundred Thousand Dollars ($200,000.00) is hereby appropriated from the Operation, Maintenance, and Construction Improvement Fund of the Lower Meramec River Basin to reimburse American Heritage Homes, L.L.C. for the costs of construction of sanitary sewers as undertaken by American Heritage Homes, L.L.C. in Williams Creek Sanitary Interceptor Phase IIB (2000046B) in St. Louis County, Missouri. Section Two. The Executive Director and Secretary-Treasurer are hereby authorized on behalf of The Metropolitan St. Louis Sewer District to enter into a contract with American Heritage Homes, L.L.C. whereby the District will reimburse American Heritage Homes, L.L.C. for the cost of construction of sanitary sewers as undertaken by American Heritage Homes, L.L.C. in Williams Creek Sanitary Interceptor Phase IIB (2000046B) in St. Louis County, Missouri; said contract to be comprised of such terms and conditions as are approved by the office of the General Counsel of the District. Section Three. This ordinance, being an appropriation ordinance, shall take effect immediately upon its enactment. The foregoing Ordinance was adopted August 31, 2006.
