HomeMy Public PortalAbout12301O R D I N A N C E NO. 12301 AN ORDINANCE, authorizing the Executive Director and Secretary-
Treasurer, on behalf of The Metropolitan St. Louis Sewer District, to execute
Amendment No. 7 to the Lease Agreement with Lange-Stegmann Fertilizer Company,
a Missouri corporation, for certain real property of the District, known and numbered
as #1 Angelica Street, in the City of St. Louis, Missouri.
WHEREAS, said real property is being used by the Lessee for the
purpose of receiving, handling, bagging, storing and shipping fertilizer and urea, and
WHEREAS, the current lease, as amended from time to time, was
authorized by Ordinance No. 4131, adopted August 27, 1980, and
WHEREAS, Lessee desires to presently effect the optional renewal
applicable to the period October 1, 2006 to September 30, 2011, and to add to the lease
the option for three additional 5-year renewal terms in favor of Lessee for the periods
October 1, 2011 to September 30, 2016; October 1, 2016 to September 30, 2021;
October 1, 2021 to September 30, 2026.
WHEREAS, the addition of three 5-year terms does not interfere with
any District operation,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Secretary-Treasurer are
hereby authorized on behalf of The Metropolitan St. Louis Sewer District to execute
Amendment No. 7 to the Lease Agreement with Lange-Stegmann Fertilizer Company,
a Missouri corporation, for certain real property of the District known and numbered
as #1 Angelica Street, in the City of St. Louis, Missouri.
Section Two. The lease Amendment No. 7 as herein authorized shall be
comprised of such terms and conditions as are approved by the office of General
Counsel of the District.
