HomeMy Public PortalAbout12324O R D I N A N C E NO. 12324 AN ORDINANCE, authorizing the Executive Director and Secretary- Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into a Memorandum of Agreement with the Missouri Highways and Transportation Commission for sewer relocation and betterments during the design and construction of improvements to Route I-64 from west of Spoede Road in St. Louis County to Sarah Street in St. Louis City. (Project) WHEREAS, from time to time, the construction, reconstruction, improvement, maintenance and operation of the project will require changes to the sanitary and storm sewer system and Facilities owned and maintained by the District. Such activities may require the District’s Facilities to be relocated, abandoned, protected, removed, replaced, reinstalled or modified according to the District’s standards and requirements. WHEREAS, the Missouri Highways and Transportation Commission and the District desire to cooperate for the purpose of ensuring that all sanitary and storm sewer relocation and betterment work for District Facilities necessary to accommodate the project is promptly performed, and in close coordination with the Commission’s Contractor’s performance of the project, in order to minimize delay, uncertainty, and risk, and to eliminate resulting additional project costs; WHEREAS, to accomplish that purpose, the Commission and the District desire to enter into an Agreement, which contains general terms applicable to such coordination and to the performance of all Facility Work; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and Secretary-Treasurer are hereby authorized on behalf of The Metropolitan St. Louis Sewer District to enter into a Memorandum of Agreement with the Missouri Highways and Transportation Commission for sewer relocation and betterments during the design and construction of improvements to Route I-64 from west of Spoede Road in St. Louis County to Sarah Street in St. Louis City. (Project) Section Two. The Memorandum of Agreement as authorized in Section One of this ordinance shall be comprised of such terms and conditions as are approved by the office of the General Counsel of the District. The foregoing Ordinance was adopted October 12, 2006.
