HomeMy Public PortalAbout12393O R D I N A N C E NO. 12393 AN ORDINANCE, authorizing the Executive Director and Secretary- Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into an Intergovernmental Agreement with the City of Arnold, Missouri, whereby the District will accept and treat sewage generated within the sewer system boundaries of said City as conveyed to the District’s Lower Meramec Wastewater Treatment Plant by said City. WHEREAS, the Charter of The Metropolitan St. Louis Sewer District empowers the District to contract with municipalities, districts, other public agencies, individuals, or private corporations, or any of them whether within or without the District, for the construction, use, or maintenance of common or joint sewers, drains, outlets, or disposal plants, or for the performance of any service required by the District; and for the connection with and use of the facilities of the District, and WHEREAS, said Intergovernmental Agreement will provide that the City of Arnold, Missouri will reimburse the District for said City’s share of the costs associated with the construction of the Lower Meramec Wastewater Treatment Facilities, said City’s share of the future costs associated with the planned expansion of said facilities, and the ongoing cost associated with the treatment of said City’s sewage, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT Section One. The Executive Director and Secretary-Treasurer are hereby authorized on behalf of The Metropolitan St. Louis Sewer District to enter into an Intergovernmental Agreement with the City of Arnold, Missouri, whereby the District will accept and treat sewage generated within the sewer system boundaries of said City as conveyed to the District’s Lower Meramec Wastewater Treatment Plant by said City. Section Two. The Intergovernmental Agreement authorized in Section One of this ordinance shall be comprised of such terms and conditions as are approved by the General Counsel of the District. The foregoing Ordinance was adopted February 8, 2007.
