AN ORDINANCE, authorizing the Executive Director of The
Metropolitan St. Louis Sewer District to distribute funds deposited with the District
by the State of Missouri, pursuant to the Missouri State Stormwater Grant/Loan
Assistance Program, to the City of St. Louis, St. Louis County and various
municipalities in the greater St. Louis area within St. Louis County for application
toward the cost of qualified stormwater projects.
WHEREAS, the State of Missouri has designated The Metropolitan
St. Louis Sewer District to administer The Missouri State Stormwater Grant/Loan
Assistance Program in the greater St. Louis area, and
WHEREAS, pursuant to said program, the State of Missouri
deposits funds with the District, and
WHEREAS, the District must administer, distribute, and recapture if
necessary, said funds to the City of St. Louis, St. Louis County and various
municipalities in the greater St. Louis area within St. Louis County for application
toward the costs of qualified stormwater projects, and
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Secretary-Treasurer on
behalf of the Metropolitan St. Louis Sewer District is hereby authorized to
administer, distribute ,and recapture if necessary, funds deposited with the
District by the State of Missouri, pursuant to the Missouri State Stormwater,
Grant/Loan Assistance Program, as amended from time to time, to the City of St.
Louis, St. Louis County and various municipalities in the greater St. Louis area
within St. Louis County and to reimburse the District for qualified stormwater
work performed.
Section Two. The Executive Director and Secretary-Treasurer of
The Metropolitan St. Louis sewer District is hereby authorized to enter into the
appropriate intergovernmental contracts and agreements that are necessary to
effectively administer the Missouri State Stormwater, Grant/Loan Assistance
Program.
Section Three. It is critical that the District continue to administer
and distribute, the funds deposited by the State of Missouri, pursuant to the
Missouri State Stormwater, Grant/Loan Assistance Program, in an unbroken
manner, thus creating an emergency within the meaning of the Charter;
accordingly, this ordinance shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted March 20, 2007.
