AN ORDINANCE, ratifying Supplemental Lease Agreements by and
between The Metropolitan St. Louis Sewer District and the United States of
America extending through March 31, 2007 the term of the lease of a portion
of certain real property of the District known and numbered as 2350 Market
Street in the City of St. Louis, Missouri as leased by the District to the United
States of America; and authorizing the Executive Director and Secretary-
Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into a
Lease Agreement with the United States of America whereby the District will
continue to lease a portion of certain real property of the District known and
numbered as 2350 Market Street in the City of St. Louis, Missouri to the
United States of America for the term of April 1, 2007 through March 31, 2010,
with two (2) additional one-year renewal terms at the option of the District,
with an emergency clause.
WHEREAS, the aforesaid lease of the United States of America was
assumed by the District upon the District’s purchase of said real property on
February 8, 2002, and
WHEREAS, said lease expired on January 31, 2007, and the
District and the United States of America desire to enter into a new lease
agreement for the portion of said District real property to commence on April 1,
2007 and terminate on February 28, 2010.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT
Section One. The Supplemental Lease Agreements by and between
The Metropolitan St. Louis Sewer District and the United States of America
extending through March 31, 2007 the term of the lease of a portion of certain
real property of the District known and numbered as 2350 Market Street in the
City of St. Louis, Missouri as leased by the District to the United States of
America are hereby ratified.
Section Two. The Executive Director and Secretary-Treasurer are
hereby authorized on behalf of The Metropolitan St. Louis Sewer District to
enter into a Lease Agreement with the United States of America whereby the
District will continue to lease a portion of certain real property of the District
known and numbered as 2350 Market Street in the City of St. Louis, Missouri
to the United States of America for the term of April 1, 2007 through March 31,
2010 with two (2) additional one-year renewal terms at the option of the
District.
Section Three. The Lease Agreement as authorized in Section Two
of this ordinance shall be comprised of such terms and conditions as are
approved by the office of the General Counsel of the District.
Section Four. The original Lease Agreement for the aforesaid
District real property has expired, and it is critical that the new Lease
Agreement be implemented without delay, thus creating an emergency within
the meaning of the District Charter. Accordingly, this ordinance shall take
effect immediately upon its enactment.
The foregoing Ordinance was adopted March 20, 2007.
