HomeMy Public PortalAbout12414O R D I N A N C E NO. 12414 AN ORDINANCE, declaring the necessity for the acquisition of easements and licenses in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of sewers and related appurtenances in the project known as CC-11 and CC-20 Creve Coeur Creek Sanitary Relief Phase II (SKME-025) (89130A) to serve the needs of residents of the area, and authorizing the acquisition of said easements and licenses by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of the County of St. Louis within the Creve Coeur Creek Watershed wherein live and work numerous people; and WHEREAS, sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements and licenses in real property for the construction of sewers and related appurtenances in the project known as CC-11 and CC-20 Creve Coeur Creek Sanitary Relief Phase II (SKME-025) (89130A) as hereinafter set forth, said easements and licenses being more particularly described below: CC-11 & CC-20 Creve Coeur Creek Sanitary Relief M.S.D. Project No. 89130 Rassieur Property 17P-42-0111 Two (2) TEMPORARY CONSTRUCTION LICENSES across Lot 30 of Muirfield, a subdivision according to the plat thereof recorded in Plat Book 115, Page 63 of the St. Louis County, Missouri Recorder’s Office, being more particularly described as follows: TEMPORARY CONSTRUCTION LICENSE NO. 1 COMMENCING at the intersection of the right-of-way line of Muirfield (50 foot wide) Lane and the common line between Lots30 and 31; THENCE North 38 degrees 58 minutes 09 seconds West, along the said common line, a distance of 215.99 feet to the POINT OF BEGINNING of the herein described TEMPORARY CONSTRUCTION LICENSE NO. 1; THENCE North 86 degrees 17 minutes 23 seconds West a distance of 16.51 feet to a point; THENCE South 64 degrees 22 minutes 20 seconds West a distance of 255.72 feet to a point, said point being on the northeast line of an existing 5.00 foot wide easement, as recorded in Plat Book 115, Page 63 and Deed Book 10383, Page 1270 of the St. Louis County, Missouri Recorder’s Office; THENCE North 42 degrees 51 minutes 54 seconds West, along the said northeast line, a distance of 20.94 feet to a point, said point being the intersection of the said northeast line and the southeast line of an existing 10.00 foot wide easement, as recorded in Plat Book 115, Page 63 and Deed Book 10383 Page 1270 of the St. Louis County, Missouri Recorder’s Office; THENCE North 64 degrees 22 minutes 20 seconds East, along said southeast line, a distance of 267.16 feet to a point; THENCE South 86 degrees 17 minutes 23 seconds East, along said southeast line, a distance of 3.30 feet to a point; THENCE South 38 degrees 58 minutes 09 seconds East, along said common line, a distance of 27.21 feet to the POINT OF BEGINNING. Project No. 89130 Fox Property 17P-51-0036 A 10.00 foot wide SEWER EASEMENT across Lot 33 of Muirfield, a subdivision according to the plat thereof recorded in Plat Book 115, Page 63 of the St. Louis County, Missouri Recorder’s Office, the centerline of said 10.00 foot wide Sewer Easement being more particularly described as follows: COMMENCING at the Northeast corner of said Lot 33; THENCE South 10 degrees 37 minutes 06 seconds West, along the East line of said Lot 33 a distance of 47.53 feet to a point; THENCE South 76 degrees 53 minutes 31 seconds West a distance of 10.92 feet to the POINT OF BEGINNING of the centerline of said 10.00 foot wide Sewer Easement, said Point of Beginning also being on the West line of an existing 10.00 foot wide easement as recorded in said Plat Book 115 Page 63 and Deed Book 10383 Page 1270 of said Recorder’s Office; THENCE South 76 degrees 53 minutes 31 seconds West a distance of 31.58 feet to a point; THENCE South 87 degrees 19 minutes 22 seconds West a distance of 48.20 feet to the POINT OF TERMINATION of the centerline of the said 10.00 foot wide Sewer Easement, said Point of Termination being South 06 degrees 59 minutes 06 seconds West along the West line of said Lot 33, a distance of 32.45 feet from the Northwest corner of said Lot 33. A 20.00 FOOT WIDE TEMPORARY CONSTRUCTION LICENSE NO. 2 A 20.00 foot wide temporary construction license adjacent to the south line of the above described 10.00 foot wide Sewer Easement, bounded on the west by the west line of said Lot 33 and bounded on the east by the west line of an existing 10.00 foot wide easement recorded in Plat Book 115 Page 63 and Deed Book 10383 Page 1270 of said recorder’s office.
