HomeMy Public PortalAbout12415O R D I N A N C E NO. 12415 AN ORDINANCE, declaring the necessity for the acquisition of easements and licenses in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of sewers and related appurtenances in the project known as Eva-Wabash Sanitary Relief Phase I (SKME-217) (2001049) to serve the needs of residents of the area, and authorizing the acquisition of said easements and licenses by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of the County of St. Louis within the Coldwater Creek Watershed wherein live and work numerous people; and WHEREAS, sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements and licenses in real property for the construction of sewers and related appurtenances in the project known as Eva-Wabash Sanitary Relief Phase I (SKME-217) (2001049) as hereinafter set forth, said easements and licenses being more particularly described below: Eva – Wabash Sanitary Relief M.S.D. Project No. 2001049 Velma Vasquez, Trustee 10K-230-031 A 10.00 FOOT WIDE SEWER EASEMENT across part of Lot A of Frost Industrial Park as recorded in Plat Book 142, Page 99 of the St. Louis County Recorder’s Office, St. Louis County, Missouri, being more particularly described as follows: BEGINNING at the northwest corner of said Lot A, said point lying on the south right-of-way line of Frost Avenue (width varies); THENCE South 82 degrees 41 minutes 20 seconds East, along said south right-of-way line a distance of 60.00 feet to a point, said point being on the west line of an existing 10.00 foot wide easement as recorded in Deed Book 5905, Page 348 of the St. Louis County Recorder’s Office; THENCE South 07 degrees 26 minutes 11 seconds West, along said west line a distance of 10.00 feet to a point; THENCE North 82 degrees 41 minutes 20 seconds West a distance of 60.00 feet to a point, said point being on the west line of said Lot A; THENCE North 07 degrees 26 minutes 11 seconds East, along said west line of Lot A a distance of 10.00 feet to the POINT OF BEGINNING. Also, a 15.00 FOOT WIDE TEMPORARY CONSTRUCTION LICENSE for use during the construction of any sewer in the above described sewer easement, said temporary construction license being more particularly described as follows: A 15.00 Foot Wide Temporary Construction License adjacent to the south line of the above described 10.00 Foot Wide Sewer Easement, bounded on the west by the west line of said Lot A and bounded on the east by the west line of said existing 10.00 foot wide easement as recorded in Deed Book 5905, Page 348 of the St. Louis County Recorder’s Office. TEMPORARY CONSTRUCTION LICENSE will become null and void upon completion of the above described sewer construction. Eva – Wabash Sanitary Relief M.S.D. Project No. 2001049 Moreco, A Missouri General Partnership 11K-63-0210 A 15.00 FOOT WIDE SEWER EASEMENT across a tract of land being in U.S. Survey 2979, Township 46 North, Range 6 East, St. Louis County, Missouri, being more particularly described as follows: BEGINNING at the intersection of the north line of Norfolk Southern Railroad right-of-way (300’ wide) as recorded in Deed Book 3209, Page 574 of the St. Louis County, Missouri Recorder’s Office and the west right-of-way line of Graham (60.00 foot wide) Road; THENCE North 73 degrees 42 minutes 29 seconds West, along said north right-of-way line a distance of 15.58 feet to a point; THENCE North 00 degrees 35 minutes 39 seconds East a distance of 373.76 feet to a point, said point being on the southwest line of an existing easement as recorded in Deed Book 10176, Page 1217 of the said St. Louis County Recorder’s Office; THENCE South 48 degrees 48 minutes 16 seconds East, along said southwest line of an existing easement a distance of 19.76 feet to a point, said point also being on the said west right-of-way line of Graham Road; THENCE South 00 degrees 35 minutes 39 seconds West, along said west right-of-way line a distance of 365.12 feet to the POINT OF BEGINNING. Also, a 25.00 FOOT WIDE TEMPORARY CONSTRUCTION LICENSE for use during the construction of any sewer in the above described sewer easement, said temporary construction license being more particularly described as follows: COMMENCING at the intersection of the north line of Norfolk Southern Railroad right-of-way (300’ wide) as recorded in Deed Book 3209, Page 574 of the St. Louis County, Missouri Recorder’s Office and the west right-of-way line of Graham (60.00 foot wide) Road; THENCE North 73 degrees 42 minutes 29 seconds West, along said north right-of-way line a distance of 15.58 feet to a point, said point being on the west line of above described 15.00 Foot Wide Sewer Easement, said point also being the POINT OF BEGINNING of the herein described 25.00 foot wide temporary construction license; THENCE North 73 degrees 42 minutes 29 seconds West, along said north line a distance of 25.97 feet to a point; THENCE North 00 degrees 35 minutes 39 seconds East a distance 366.74 feet to a point; THENCE South 89 degrees 24 minutes 21 seconds East a distance of 25.00 feet to a point; said point being on the southwest line of an existing easement as recorded in Deed Book 10176, Page 1217 of said St. Louis County Recorder’s Office; THENCE South 00 degrees 35 minutes 39 seconds West, along the west line of the above described 15.00 foot wide sewer easement, a distance of 373.76 feet to the POINT OF BEGINNING. TEMPORARY CONSTRUCTION LICENSE will become null and void upon completion of the above described sewer construction. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase if possible, or to institute and prosecute an action in condemnation pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property rights as hereinabove set out. The foregoing Ordinance was adopted April 26, 2007.
