To provide equipment listed above,to install the same in a thorough workmanlike manner and to maintain the same in safe working order. CUSTOMER AGREES: Use of Tank: to assure safety in delivery and servicing,not to allow any other supplier or servicing agent to supply petroleum products or service the equipment. Payment: to pay equipment fee,LP-gas invoices,fuel invoices,or service orders within 10 days of the first billing. Taxes: to pay all licenses, personal property taxes or any other assessments that may be levied on equipment covered by this Agreement during the term hereof. Location: not to change the location or manner of installation of said equipment unless first obtaining written consent from Company. Access & Removal: to provide safe and unobstructed access to equipment location. Customer authorizes agents of the Company to enter Customer's premises at any reasonable time to service equipment, deliver petroleum products and upon termination of the Agreement, to remove said equipment from the premises. Company assumes no responsibility for damage caused by Customer's breech of Agreement to provide safe and unobstructed access. COMPANY & CUSTOMER MUTUALLY AGREE: Duration: this Agreement shall commence on the date below and continue in effect until canceled by either party giving 30 days written notice or canceled by Company upon Customer's non-payment of any invoice or to protect itself against abuse, harassment,theft,fraud or potential liability upon 7 days of written notice to Customer. Non-Refundable: that the charge for installation and rental fee is non-refundable. Charges: charges for equipment fee, LP-gas, and fuel prices are subject to change by Company, without notice, from time-to-time during the term of this Agreement. Excusable Failure: any failure of performance on the part of Company shall be excused without liability when failure results from accidents,weather, acts of God,fire,flood, break-down or other failure of equipment,failure of supplies of fuel or any other cause beyond reasonable control of Company. Ed Staub&Sons Petroleum, Inc. is not responsible for delivering fuel to a location without safe access. Title: that title to the equipment covered by this Agreement shall remain in the name of said Company. Title to LP-gas and petroleum products delivered into the tank shall remain with Company until billing invoice is paid in full. Customer Assumes Risk: that the Customer assumes any and all risks in connection with the use of all equipment and petroleum products and will hold Company harmless for any damage or injury directly or indirectly arising from such use. Agreement: Customer shall not assign this Agreement without written consent from Company. Agreement shall not be transferred without written consent from Company. Fees: in the event of legal proceedings involving this Agreement,the prevailing party shall be paid reasonable attorney's fees by the other party. DELIVERY SERVICE: (please choose one option below by signing with your initials) Option 1 —Routed Deliveries: Ed Staub&Sons will use prior usage history to estimate when the tank will reach 25%,which triggers a delivery. I understand that it is ultimately my responsibility to notify Ed Staub&Sons when I am in need of a delivery. Ed Staub&Sons is not responsible in the event of my tank running out of fuel,or the damage that may occur.I understand it is my responsibility to notify Ed Staub&Sons if I add or remove an appliance or plan to significantly increase my fuel usage as this wiI,�q-ffect the frequency and timeliness of deliveries. Option 2—Tank Monitoring Service: I authorize Ed Staub&Sons to charge an annual subscription of$ per year for the use of the following equipment: Tank Monitoring House Temperature -Web based information access to the monitoring equipment -Other If the equipment is damaged, I will pay for the equipment at replacement cost. Customer Initials Option 3—Will-Call: I will contact Ed Staub&Sons for a delivery to be dispatched to the specified tank. Ed Staub&Sons is not responsible for the tank running out of fuel, or any damage that may occur. If Ed Staub&Sons is not given adequate time to make the delivery, I may be subject to an off-route fee,which will be determined when I place the order. I may also be required to pay a Leak Check fee if the tank runs out of product.
