HomeMy Public PortalAboutOrdinance 66-208CAD ?NANCE NO. 6G -208 AN ORDINANCE OF THE CITY OF TEMPLE CITY SUSPENDING ORDINANCE NO. 66 -183 AND ENACTING AN INTERIM ZONING ORDIN- ANCE, PURSUANT TO THE PROVISIONS OF SECTION 65858 OF THE CALIFORNIA GOVERNMENT CODE, RELATING TO THE CON - STRUCTION OF SERVICE STATIONS AND DRIVE -IN RESTAURANTS 1AIITHIN THE CITY THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN: SECTION 1. The City Council does hereby find and determine that the Planning Commission of this City has heretofore undertaken studies to determine the appropriate zone classification for service stations and drive -in restaurants, and to ascertain whether a Special or Conditional Use Permit should be required as a prerequisite to construction thereof in order to prescribe necessary conditions to safeguard against traffic hazards and devaluation of neighboring residential properties; that said Planning Commission has heretofore adopted a Resolution making certain recommendations in connection therewith; and that this City Council, after public hearing thereon, has concurred in such recommendation for inclusion in the new zoning code now in process of preparation. SECTION 2. The City Council further finds that the pro- cessing of the new zoning code including such recommendation is con- templated by the Planning Commission and City Council within the next few months, and that to permit further construction of service sta- tions and drive -in restaurants prior to the consummation of the appropriate hearings thereon would in large measure emasculate the benefits to be derived therefrom and would be contrary to the best interests and general welfare of the residents of this City. SECTION 3. Pending completion of such revised zoning code and review thereof, and pursuant to the provisions of Section 65858 of the Government Code, a prerequisite Conditional Use Permit, pro- cessed and issued pursuant to the existing zoning code, is hereby im- posed upon the construction, and issuance of building permits for the construction and substantial reconstruction, of service stations and drive -in restaurants in the City. SECTION 4. The provisions of the Temple City Municipal Code authorizing the construction of such service stations and drive - in restaurants without such Conditional Use Permit are hereby suspend- ed. SECTION 5. This Ordinance shall remain in effect until November 16, 1966, and the Building Inspector of this City is directe,, . not to issue any building permit for a service station or drive -in restaurant construction or substantial reconstruction during the term of this Ordinance, except in compliance with a Conditional Use Permit first issued therefor. SECTION 6. This Ordinance shall become immediately effect1ti, pursuant to the provisions of Section 65858 of the Government Code and for the reasons above stated, and is adopted pursuant to the authority of Anderson v. Pleasant Hills, 229 A.C.A. 81; Metro Realty v. Country of El Dorado, 222 A.C.A. 560; Hunter v. Adams, —T80 C.A.7d 511; Los Aries v. Su erior Court, 221 A.C.A. 151; 44 A.G. Ops. 14; a and Slater v. Los nqe es, Q.C.A. 937. SECTION 7. Ordinance No. 66 -183 is superseded hereby. SECTION 8. The City Clerk of the City of Temple City shall certify to the passage and adoption of this Ordinance and to its ap- proval by the Mayor and shall cause the same to be published in the Temple City Times, a newspaper of general circulation, printed, pub- lished and circulated in the City of Temple City. 568 1 1 1 Ordinance No. 66-208, page 2 PASSED, APPROVED AND ADOPTED this 16th day of August, 1966.
