A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
DECLARING ITS INTENTION TO ABATE DRY AND DRYING WEEDS ON
CERTAIN PARCELS OFLAND IN THE CITY OF LYNWOOD FOR FISCAL
YEAR 2005 - 2006.
WHEREAS, Chapter 13 of the Government Code, cited as "Weed and
Rubbish Abatement" provides for abatement of dry and dying weeds, stubble, brush,
litter, or other flammable material, that constitute public nuisance; and
WHEREAS, it has been brought to the attention of the City Council of the City
of Lynwood by the Director of Environmental Services that there exists a public
nuisance on certain parcels of land in the City of Lynwood, as set forth in Attachment
"A" attached herewith.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Lynwood as follows:
Section 1: That by reason of dry and drying weeds, stubble, brush, litter of
other flammable material being located on or in front thereof, a public nuisance
exists upon the parcel of land, lots or portions of lots set forth in Attachment "A",
which shall be made a part of this resolution.
Section 2: That said weeds are hereby declared to be seasonal and
current nuisances.
Section 3: That said weeds and/or stubble, brush, litter or other flammable
material which endangers the public safety by creating a fire hazard, constitute a
public nuisance which must be abated by the removal thereof and that if the same
are not removed by the owner of the properties, the nuisance will be abated by the
City and the cost thereof assessed upon said properties and that upon confirmation,
such costs will constitute lien thereon until paid.
Section 4: The Director of Environmental Services is directed to cause said
notices to be posted in the time, form and manner required by law.
Section 5: That the proceedings for said work shall be taken under an Act
of Legislature of the State of California designated as the Government Code,
Chapter 13, Section 39501, et. cited' as "Weeds and Rubbish Abatement", and
amendments thereto.
Section 6: Notice is hereby given that on July 19, 2005 at the hour of 5:00
p.m. in the City Hall, Council Chambers, 11330 Bullis Road, in the City of Lynwood,
any and all persons having any objections or protests to said proposed work may
appear before said City Council and show cause why said proposed work should not
be carried out in accordance with said Act.
Section 7: This resolution shall take effect immediately upon its adoption.
