M. Members Present: Mayor, Thomas Anderson; Councilmembers, Wilfred Scherer, Thomas Crosby, William Reiser; Police Chief, Charles Hoover; Planning and Zoning Adminis- trator, JoEllen Hurr; Engineer, Dave Hansing; Attorney, Richard Schieffer; Acting Clerk, Sylvia Rudolph Absent: Public Works Director, Ronald Duran; Sarah Lutz arrived at 8:20 P. M. Mayor Anderson requested the following additions and deletions from the agenda: Add: Northwest Chamber Dues Delete: Rey Swanson barn variance at the request of his attorney, Joseph Finley. Michael Vrooman barn variance on request of JoEllen Hurr. Thomas Anderson inquired about agreement with Elm Creek - Phil Zietlow was not present to respond. Motion by Thomas Crosby, seconded by Wilfred Scherer to Add and Delete the above items. Motion declared carried. 1. MINUTES OF JANUARY 20, 1981 Motion by Thomas Crosby, seconded by Bill Reiser to approve the minutes of January 20, 1981 as presented. Motion declared carried. 2. PUBLIC WORKS DEPARTMENT Northwestern Bell Telephone Tabled burial of cable on Brockton Lane, Holy Name Drive and Medina Road until ditching can be done. Bonding Bill Fahey of Ehlers and Associates presented bonding information for the sale of bonds for the Medina Morningside Sewer and Water, Hamel Sidewalks and Hamel Road, Tower Drive and Pinto Drive street improvements. He reported that the bond market is not stable but to have the offering ready for the sale of bonds when the market changes. The length of the bond issue was discussed. Thomas Crosby suggested that Ehlers and Associates prepare an outline of things the city needs to do for the sale of bonds and present it to the City Council at the February 16, 1981 meeting. Kilkenny Drive Motion by Wilfred Scherer, seconded by Thomas Crosby to accept Kilkenny Drive as a City Street. Motion declared carried. Water Treatment Thomas Anderson reported on the costs from Lindsay, Inc. of installing an iron filter and softener on a trial basis. He felt that the city should not go along with this. Wilfred Scherer stated that there is a product available that is pumped at the well before it goes into the main to dissolve the rust. Dave Hansing will look into this and report back to the council. Vehicles Motion by Bill Reiser, seconded by Thomas Crosby to sell the city car and power wagon and the possibility of the patch tank at Public Auction. Motion declared carried. 3. HAMEL FIRE DEPARTMENT - RELIhil ASSOCIATION Howard Guest presented the By -Laws and Pension Benefits of the Hamel Fire Department. They are are receiving 325.00 per year of service and are asking it to be raised to 150.00 per year. Tom Anderson appointed Bill Reiser and himself as representatives. Motion by Thomas Crosby, seconded by Sarah Lutz to accept the representatives and By - Laws as presented. Motion declared carried. 4. PLANNING AND ZONING Board of Appeals The Board of Appeals should be the City Council and will require an ammendment to the Zoning Ordinance. JoEllen Hurr after discussing with Chuck Riesenberg will schedule a public hearing to draft the ammendment to the Ordinance. (152) Ervin Zwiefelhofer Motion by Thomas Crosby, seconded by Wilfred Scherer to accept Mr. Zwiefelhofers request to withdraw his variance, reason being if the assessory buildings are moved close together enough they would be considered one building and no variance is needed. The Building Inspector concurs with the Council considering this one building, with a building permit to be taken out for the buildings moved in. Motion declared carried. Thomas and Nancy Malik Attorney Earle Anderson representing the Maliks requested a variance for the barn set -back. Mr. Anderson proposes that the addition was to an existing barn. The building permit taken out in 1974 was for a garage. The permit taken out in August 1980 was for storage. After much discussion, a motion was made by Thomas Crosby, seconded by Wilfred Scherer to table the matter for his further investigation of the Ordinance and how this request might meet their requirements. Motion declared carried Michael and Sandra Vrooman Mrs. Vrooman appeared and asked to have her barn variance heard. She presented slides and a diagram of the property. Council discussed the fact that they do have 10 acres and are classified as a farm. Richard Schieffer agrees with the Building Inspector that the existing location is probably the best site considering the land. Motion by Thomas Crosby, seconded by Bill Reiser to table the matter for the same reason as the Maliks. Motion declared carried. JoEllen Hurr will prepare a list of the existing barn problems in the City. Woodlake Expansion JoEllen Hurr reported on the expansion of the Woodlake Sanitary Landfill. She and Tom Anderson have met with the P. C. A. and Metro Council about the short term and full ex- pansion. Tom Anderson expressed concerns that they are today in violation of the City Ordinance by their using land in a non -permitted area. The public notice and conditions dated January 29, 1981 issued by the P. C. A. was discussed. JoEllen was instructed to write a letter to the operator about his illegal expansion of the landfill operation. JoEllen was instructed to verbally relay the following concerns to the Advisory Committee (2-4-81) and Physical Development Committee (2-5-81) of the Met Council. (1) No formal application for short term or full expansion has been made by Woodlake to thy City of Medina. (2) The short term and full expansion is contrary to the local Zoning Ordinance. Expansion of a legal non -conforming use is not allowed. The City is concerned about a time to cease operation and removing any fill illegally placed. The City is hopefull of cooperation of all agencies that are part of this review. (3) 5. HENNEPIN CO. SOLID WASTE SELECTION SITE PROCESS Mr. Harry Poole and Mr. Virgil Marple presented information on the 5 sites that are to be picked in the 7 county area. They also presented a brochure of questions and answers pertaining to the selection site process. 6. PARK COMMISSION Anne Heideman reported the Orono School had received 7 B. Q. grills that were not ordered. The City of Maple Plain bought 3 and have 4 left for sale at 50.00 each. Motion by Bill Reiser, seconded by Thomas Crosby to purchase the 4 grills at $50.00 each. Motion declared carried. 7. BILLS Motion by Bill Reiser, seconded by Sarah Lutz to pay the bills: Order Checks # 9277-9339 in the amount of S109,891.52 and Payroll checks #6086-6107in the amount of $8,846.32. Motion declared carried. 8. PERSONNEL POLICY Tom Anderson appointed Charles Hoover, Ronald Duran, Donna Roehl, Robert Linkenhiel and Anne Heideman to review the personnel policy. He would like to have Thomas Crosby present also. 9. LEAGUE OF CITIES Motion by Sarah Lutz, seconded by Thomas Crosby to deny the request for the cities contribution to the office building project proposed by the League of Minnesots Cities. Donna Roehl to write a letter to the League stating this. Motion declared carried. 10. NORTHWEST CHAMBER OF COMMERCE Motion by Bill Reiser, seconded by Thomas Crosby to pay the 1981 dues of $50.00 Motion declared carried. Motion by Thomas Crosby, seconded by Sarah Lutz to adjourn.
