A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD AUTHORIZING THE MAYOR TO EXECUTE AN
EASEMENT AGREEMENT THEREBY ACCEPTING AN EASEMENT
INTEREST IN REAL PROPERTY LOCATED IN THE CITY OF
LYNWOOD, CALIFORNIA AND CONSENTING TO THE
RECORDATION OF SAID EASEMENT AGREEMENT
WItEREAS, the City of Lynwood is a public body, corporate and politic, established as
a General Law City and is governed by an elected body of five council members; and
WHEREAS, Government Code §37350 gives a General Law City the power to
purchase, lease, receive, hold, and enjoy real and personal property, and control and dispose of it
for the common benefit; and
WHEREAS, pursuant to §37351 of Government Code, the legislative body of a City
may purchase, lease, exchange, or receive real estate situated inside or outside the city limits as
is necessary or proper for municipal purposes; and
WHEREAS, to correct an inadvertent transfer of property rights in Lynwood Water Well
No. 6, the City of Lynwood is accepting a conveyance from Placo Investments, LLC of an
easement interest in real property located in the City of Lynwood, California, described in
Exhibit "A" and shown on Exhibit "B" of the Easement Agreement attached hereto; and
WHEREAS, Government Code §27281 requires that grant deeds conveying interests in
or easements upon real property to public agencies for public purposes be accompanied by a
resolution of the agency before they may be accepted for recordation.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Lynwood hereby finds, orders and resolves as follows:
Section 1. That the City Council of the City of Lynwood hereby authorizes the
acceptance of a conveyance from Placo Investments, LLC to the City of Lynwood, by
authorizing the Mayor to execute the attached Easement Agreement for an easement interest in
real property located in the City of Lynwood, California, described in Exhibit "A" and shown on
Exhibit "B" of the Easement Agreement attached hereto.
Section 2. That following the execution by both parties of the attached Easement
Agreement, the City of Lynwood, as grantee, further consents to the recordation of the Easement
Agreement for said interest in the real property.
Section 3. That this Resolution is to be given effect immediately upon adoption.
