HomeMy Public PortalAboutOrdinance 3177 ORDINANCE NO. 3177 AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIAL USE PERMIT TO ALLOW AN AUTO BODY SHOP TO BE LOCATED IN THE B-3 (BUSINESS HIGHWAY COMMERCIAL) DISTRICT AT 16263 S. LILY CACHE ROAD, IN THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS WHEREAS, the Village of Plainfield has considered an application for a Special Use Permit to allow an auto body shop to be located in the B-3, Business Highway Commercial District on the property known as 16263 S. Lily Cache Road, and the Plainfield Plan Commission has made certain findings based on the evidence presented in said case that: a. The special use will not be injurious to the use and enjoyment of other property in the immediate area for the purposes already permitted, nor substantially diminish property values within the neighborhood; and b. The establishment of the special use will not impede the normal and orderly development and improvement of the adjacent properties for uses permitted in the subject zoning district. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL AND KENDALL COUNTIES, ILLINOIS AS FOLLOWS: Section 1: Recitals - The President and Board of Trustees of the Village of Plainfield hereby adopt and incorporate as their own, the above findings recited. Section 2: Approval Subject to the conditions set forth below, the President and Board of Trustees of the Village of Plainfield hereby approve the application for a Special Use Permit for an auto body shop to be located in the B-3, Business Highway Commercial District on the property known as 16263 S. Lily Cache Road, and legally described as follows: LOT 3, IN MAUER'S SUBDIVISION, BEING A SUBDIVISION OF PART OF THE WEST HALF OF THE WEST HALF OF SECTION 23, TOWNSHIP 36 NORTH, RANGE 9 EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED SEPTEMBER 8, 1956 AS DOCUMENT NO. 805900, IN WILL COUNTY, ILLINOIS. PIN: 06-03-23-300-005-0000 Property Address: 16263 S. Lily Cache Road, Plainfield, Illinois 60586 Section 3: Conditions — That said Special Use Permit shall be subject to the following conditions: 1. Compliance with the requirements of the Village Engineer. 2. Compliance with the provisions of the Plainfield Fire Protection District. 3. Submittal of a landscape plan for the subject site prior to Village Board consideration. 4. Submittal of a tree survey and preservation of mature trees along the western and southern perimeter of the subject site. Section 4: Severability - The various portions of this Ordinance are hereby expressly declared to be severable, and the invalidity of any such portion of this Ordinance shall not affect the validity of any other portions of this Ordinance, which shall be enforced to the fullest extent possible. Section 5: Repealer - All ordinances or portions of ordinances previously passed or adopted by the Village of Plainfield that conflict with or are inconsistent with the provisions of this Ordinance are hereby repealed. Section 6: Effective Date — This Ordinance shall be in full force and effect from and after its passage and approval. PASSED THIS 18TH DAY OF AUGUST, 2014.
