Reiman at approximately 6:00 p.m. on Thursday, January 18, 2024 in the Council Chambers of the Memorial Municipal Building, 61 Cooke Avenue, Carteret, New Jersey. Upon individual roll call, the following were noted present: ROLL CALL Councilmember Vincent Bellino Jorge Diaz Dennis DiMascio Ajmar Johal Randy Krum SusanNaples Also noted present were Carmela Pogorzelski, Municipal Clerk and Robert J. Bergen, Law Director. The meeting was opened with a moment of silent prayer and the PRAYER, PLEDGE Pledge of Allegiance led by Councilmember Krum. Upon MMS&C, by Councilmembers Krum and Bellino and APPROVAL OF unanimous affirmative vote of the full membership present, the MINUTES minutes of December 28, 2023 and January 2, 2024 were approved as transcribed and engrossed by the Clerk. No. Dale of Adoption February 8, 2024 APPROVING FINAL PAYMENT & CLOSEOUT CHANGE ORDER IMPROVEMENTS TO M1LIK STREET & MINUE STREET WHEREAS, the Governing Body of the Borough of Carteret has previously awarded a contract to P&A Construction, Inc. in the original contract amount of $2,994,610.65 for the Improvements to Milik Street and Minue Street Project; and WHEREAS, the Borough's Consulting Engineer for the project, CME Associates, has advised the Governing Body that a modification of the contract is reasonable and necessary and has recommended that the aforesaid contract be modified in accordance with Final Payment & Closeout Change Order (see attached); and WHEREAS, Final Payment & the Closeout Change Order include a change in the description of work and/or to decrease quantities to reflect as -built conditions, and to provide for certain supplementary items; and WHEREAS, the Closeout Change Order provides for an increase in the contract price in the amount of $18,262.46, resulting in a revised contract price of $3,012,863.13 including all previously approved change orders; and WHEREAS, the Borough's Consulting Engineer, CME Associates has advised that the above described changes and/or modification to the project were unforeseen at the time of the award of the original contract. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Carteret as follows: t. That Final Payment the Closeout Change Order attached hereto and made a part hereof, resulting in an increase of $18,262.46 and resulting in a revised contract price of $3,012,863.13 is hereby approved. 2. That the appropriate Borough Officials are hereby authorized to execute Final Payment and Closeout Change Order, and issue payment thereon, based upon the recommendation of the Borough Engineer and subject to attorneys review of the maintenance bond. 3. The real property shall not be sold for less than the minimum set for said real property. The auction for said sale at which bids will be received orally and publicly shall take place on February 23, 2024 at 11 a.m. at the Borough of Carteret War Memorial Municipal Building, 61 Cooke Avenue, Carteret, New Jersey 07008. This sale may be adjourned at the time advertised for not more than (1) week without re -advertising. 4. Conditions of Sale. The aforesaid property shall be sold by the Borough of Carteret subject to the following conditions: A. The Mayor and Council reserve the right to reject the highest bid at the time the bids are received and further shall have the right to reserve decision on the highest bid and either accept or reject the highest bid no later than at the second regular meeting of the Mayor and Council following the receipt of bids. NOW THEREFORE BE IT FURTHER RESOLVED that Carteret Police Department is hereby authorized to acquire items of non -controlled property designated "DEMIL A," which may include office supplies, -office furniture, computers, electronic equipment, generators, field packs, non-military vehicles, clothing, traffic and transit signal systems, exercise equipment, farrning and moving equipment; storage devices and containers, tools, medical and first aid equipment and supplies, personal protection equipment and supplies, construction materials, lighting supplies, beds and sleeping mats, wet and cold weather equipment and supplies, respirators, binoculars, and any other supplies or equipment of a non-military nature identified by the LEA, if it shall become available in the period of time for which this resolution authorizes, based on the needs of the Carteret Police Department, without restriction; and NOW THEREFORE BE IT FURTHER R)SOLVED that Carteret Police Department is hereby authorized to acquire the following "DEMIL B through Q" property, if it shall become available in the period -of time for which this resolution authorizes; and BE IT FURTHER RESOLVED, that the "DEMIL B through Q" controlled 3-page property list in its entirety is hereby approved and hereto attached to this resolution; and BE IT FURTHER RESOLVED that the Carteret Police Department shall develop and implement a full training plan and policy for the maintenance and use of the acquired property; and NO.
