HomeMy Public PortalAbout12542O R D I N A N C E NO. 12542 AN ORDINANCE, vacating easements or portions of easements of various widths in Lots 2 and 3 of “The Home Depot of Ellisville” according to the plat thereof recorded in Plat Book 348, Page 317 and in “Ellisville Towne Centre Phase Two Easement Plat” according to the plat thereof recorded in Plat Book 324, Page 53 of the St. Louis County Records, in the City of Ellisville, St. Louis County, Missouri. WHEREAS, the owner of the subject property has requested this District to vacate the subject easements or portions of easements, and this District has no further use for the same. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT Section One. The portion of a sixty-foot (60’) wide right-of-way and utility easement recorded in Plat Book 324, Page 53 and vacated by plat in Plat Book 348, Page 517 as shown hachured on the attached “Easement Vacation Plat” and marked Exhibit ‘A’, sheet 1 of 2, and made a part hereof, is hereby vacated. Section Two. The portions of a ten-foot (10’) wide, fifteen-foot (15’) wide and a twenty-foot (20’) wide utility easement shown hachured on the attached “Easement Vacation Plat”, and marked Exhibit ‘A’, sheet 2 of 2, and made a part hereof, is hereby vacated. Section Three. The potions of two (2) ten-foot (10’) wide sewer easements as shown hachured on the attached “Easement Vacation Plat”, and marked Exhibit ‘A-1’ and made a part hereof, is hereby vacated. Section Four. The portion of a twenty-foot (20’) wide sewer easement as recorded in Deed Book 9068, Page 541 of the St. Louis County Records, in the City of Ellisville, St. Louis County, Missouri as shown hachured on the attached “Easement Vacation Plat”, and marked Exhibit ‘A-2’ and made a part hereof, is hereby vacated. Section Five. The portion of a variable width utility easement as recorded in Deed Book 9485, Page 1913 of the St. Louis County Records, in the City of Ellisville, St. Louis County, Missouri as shown hachured on the attached “Easement Vacation Plat”, and marked Exhibit ‘A-3’ and made a part hereof, is hereby vacated. Section Six. The portions of a variable width and a ten-foot (10’) wide sewer easements as recorded in Deed Book 15108, Page 9 of the St. Louis County Records, in the City of Ellisville, St. Louis County, Missouri as sown hachured on the attached “Easement Vacation Plat”, and marked Exhibit ‘A-4’ and made a part hereof, is hereby vacated. The foregoing Ordinance was adopted November 8, 2007.
