HomeMy Public PortalAbout2022.07.07 AAC MinutesCity of McCall — Airport Advisory Committee (AAC) Legion Hall below City Hall Meeting Minutes July 7, 2022 AAC Members present: Rick Fereday, Charles Jones, Dan Crowell USFS Staff present: Emily Hart, Airport Manager Consultants present: Rafael Flores -Estrada, T-0 Engineering Others present: Mike Anderson, Russ Stromberg, Mike Chapman, Jeff Edwards Remote participants: Mike Weiss, Mark Thorien Chair Jones called the meeting to order at 12:02 Public Comment: None Approval of amended minutes from May 5, 2022 Regular Meetings (Action Item) Rick Fereday moved, Mike Weiss seconded. Unanimously approved. Aviation Safety Group Report — Board of Realtors meeting update Russ Stromberg presented a Power Point that was shared with the Idaho Board of Realtors regarding 360° Ranch Subdivision. Mr. Stromberg worked with Mike Chapman, Dr. Jeff Edwards, and Mike Anderson. The presentation illustrated that information regarding ITD Aeronautical Airport Land Use Guidelines and associated safety hazards was not available to the Valley County Planning & Zoning Department and the Valley County P&Z Committee prior to their review and approval of 360° Ranch, and that 360° Ranch Subdivision listing agents must disclose `adverse material facts' buyers. A healthy discussion ensued in which Mike Chapman stated that the Board of Realtors agreed that the aviation concerns presented do indeed qualify as adverse material facts, but the Board of Realtors will take no position, and make no statement. They cannot cover all the details, nor address every adverse material fact. Rick Fereday asked "since the Board won't go on record, then does State Statute provide the ability to enforce? Is it a 'we don't know' or `should have known and should have disclosed' situation?" Mr. Stromberg stated "the statute is not pre- emptive, but reactive. If you don't disclose, you can be sued, but the Board can't take pre- emptive action." Mike Anderson stated "as a broker, if any of my agents gets sued, I get sued. It is incumbent on me to remind and ensure disclosure." Mr. Stromberg asked, "what can we do regarding actions or inactions involving brokers in Mountain Central Association of Realtors? One — ensure the C.U.P. and CCRs provide that the City has leverage, shall record an avigation easement with the developer and the City which shall apply to all future landowners." Mr. Stromberg stated the current avigation is `mute' on future exchanges. Chairman Jones stated that it was fantastic presentation and is not sure what we can get on Council Agenda, as an action item, or recommendation to Council that they accept this avigation easement. Mr. Stromberg stated that one attorney told him that we can't put all adverse material facts in avigation easement. Mike Weiss suggested the Star -News. The group stated: not yet, not yet. Chairman Jones asked if there can be any further action on our part? Mr. Fereday said it's important to protect the city and the county with as much up -front ammunition as we can get on an avigation easement. Unfortunately, we already have subdivisions and don't think we can stop it, concerned about time frame. Mr. Stromberg stated, "Anecdotal not factual, have to have 90 percent infrastructure in before final plat. P&Z Commissioner Sasha Childs upset and urging reengage P&Z. The leverage we have is av agreement with City." Ms. Hart informed the group that the 360° developer hasn't signed the original aviation easement. All agreed it's not a robust enough agreement. Mr. Strombreg stated that City council has to based on Rick Stein's briefing, Council approved draft agreement which does not meet requirement. Take draft off table, go back through process, new information, get with the developer. Mr, Weiss said — wait for Emily to talk to Anette and Bill, thanks for excellent presentation, let them decide. Mr. Fereday added that City doesn't require AAC approval, Mr. Stromberg says - can you make a motion, no, not an action. Emily will take it from here. Mr. Anderson asked — remember River Ranch, several encouraged City to create av easement, prominent attorneys here in town, weak doc, representing dev. Point that out, city doesn't have history of paying attention. Mr. Stromberg mentioned the Boise doc. Chairman Jones brought up - language standpoint, Driggs RPZ condos, city coop, av easement doc RE10 form, you are living. strong language. Golf course. Sold all lots. 15 degree turn, 2°d and 3`d homeowners. Can get Driggs plan. Mr. Anderson stated — engage Realtors, reference good av easement. Mr. Fereday - if properly filed, perpetuity, every title search. Airport Sewer Extension Granite Excavation, Inc. has provided an estimate to extend the sewer across Taxiway A. They cannot bore, it will be cut. They will do the work after completion of Taxiway D. Infield Hangar Develonment/Infield Utilities Master Plan, RFP small hangar complex The Airport Manager is working on RFP now and plans to release it late summer or early fall. MP 033 — East/West Taxiway update (Information Iteml/AIP 032 — Runway 16-34 Rehabilitation project update (Information Item) To -O Engineer Rafael Flores -Estrada stated that resealing of Rwy 16/34 will be done by C.R. Contracting and start on July 11. Knife River will also complete a manhole repair on Taxiway A, fun project, everything smooth, Granite is good, any questions? Runway 16/34 will re -open 0800 Friday. Emily will change NOTAM to 0800 Friday. Mr. Flores -Estrada stated both ends of the runway will have a big X. USFS Contract Update Dan Crowell stated that he has detailed in as a Forest Aviation officer, helping out Shawn Walters. His main duties is contract and payment process. The initial plan was for new schedule O&M July 1, but it didn't come in. This is part of what Mr. Crowell thought was going on Shawn's realm. Unforeseen circumstances... Scheduled now August 1 for payment. USFS is motivated to pay asap. Question: need to come in on the actual 1s`? or just out the door? Earlier or not, any questions? Ms. Hart stated it does not need to come on the actual 1of the month. SRE Strategy — Western States Cat 950M Loader Lease Superintendent Jerry Bisom presented on the Cat 950 Loader. Guaranteed buy back, City is leasing 6-8, will get different blade, it will cut down on plow time because can use as box blade, no more swapping blade/bucket. It's built by Metalpless out of Canada. Loader comes with all filters, fluids/schedule. Snow tires, the blade. John Deere 644 has 5000 hours, old blade, been used. We can keep implement; it is ours to keep after 5 years. Won't be worn out. Should get 10- 15 years. ITD $300K loader mounted snowblower. Put new blower on Deere will give us a dedicated snowblower. The Rolba is a 1991 and was down for three weeks, hard to get parts. We can have both loaders working, which will cut closures down. Chairman Jones stated we understand we can go around FAA AIP, lease instead, motion to go forward with lease. Mike Weiss move, Rick Fereday second. Vote — unanimous aye. Obstruction Removal Plan (Information Item) Apple trees to the south will be cut soon by city arborist. All trees to the north on hold until City hires a new GIS analyst. Qpen House June 25 Review (Information Item) It went great! Thanks to members of the AAC and the airport community who helped make it a super fun day. Items for Future AAC agenda: Revisit Av easement, everything above, get Jeff Edwards to do presentation about liability issues, hanging out the taxpayers, need special meeting, let them know.
