AN ORDINANCE, vacating easements or portions of easements of
various widths located in The Home Depot of Ellisville according to the plat thereof
recorded in Plat Book 348, Page 517 and in Ellisville Towne Center Phase Two
Easement Plat according to the plat thereof recorded in Plat Book 324, Page 53, also a
portion of a twenty foot (20’) wide easement recorded in Deed Book 9068, Page 541, a
variable width easement recorded in Deed Book 9485, Page 1913, and a ten (10’) wide
easement and a variable width easement recorded in Deed Book 15108, Page 9, all of
which are located in a tract of land in Section 31 Township 45 North Range 4 East and
Section 6 Township 44 North Range 4 East, in the City of Ellisville, St. Louis County,
Missouri; for the project known as Towne Centre & Truman (Kohl’s).
WHEREAS, the owners of the subject property have requested this District
to vacate the subject easements or portions of easements, replacing Ordinance No. 12542
recorded in Deed Book 17748, page 4882 of St. Louis County Records, and this District
has no further use for said easements or portions of easements,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The portion of a sixty foot (60’) wide right-of-way and utility
easement recorded in Plat Book 324, Page 53 and vacated by plat in Plat Book 348, Page
517, a ten foot (10’) wide utility easement, two fifteen foot (15’) wide utility easements,
and a twenty foot (20’) utility easement in said tract of land being Part of The Home
Depot of Ellisville and Ellisville Towne Center Phase Two Easement Plat as shown
hachured on the attached “Easement Vacation Plat”, and marked Exhibit “A”, sheet 1 of
2 and made a part hereof, is hereby vacated.
Section Two. The portion of a sixty foot (60’) wide right-of-way and utility
easement recorded in Plat Book 324, Page 53 and vacated by plat in Plat Book 348, Page
517, a ten foot (10’) wide utility easement, a twenty foot (20’) utility easement, and a
thirty-five foot (35’) wide utility easement in said tract of land being Part of The Home
Depot of Ellisville and Ellisville Towne Center Phase Two Easement Plat as shown
hachured on the attached “Easement Vacation Plat”, and marked Exhibit “A”, sheet 2 of
2 and made a part hereof, is hereby vacated.
Section Three. The two ten foot (10’) wide easements in said tract of land
being Part of The Home Depot of Ellisville as shown hachured on the attached
“Easement Vacation Plat”, and marked Exhibit “A-1” and made a part hereof, is hereby
vacated.
Section Four. The portion of a twenty foot (20’) wide easement as recorded
in Deed Book 9068, Page 541 in said tract of land being Part of Section 31 Township 45
North Range 4 East and Section 6 Township 44 North Range 4 East as shown hachured
on the attached “Easement Vacation Plat”, and marked Exhibit “A-2” and made a part
hereof, is hereby vacated.
Section Five. The portion of a variable width easement as recorded in Deed
Book 9485, Page 1913 in said tract of land being Part of Section 31 Township 45 North
Range 4 East and Section 6 Township 44 North Range 4 East as shown hachured on the
attached “Easement Vacation Plat”, and marked Exhibit “A-3” and made a part hereof, is
hereby vacated.
Section Six. The ten foot (10’) wide easement and variable width easement
as recorded in Deed Book 15108, Page 9 in said tract of land being Part of Section 31
Township 45 North Range 4 East and Section 6 Township 44 North Range 4 East as
shown hachured on the attached “Easement Vacation Plat”, and marked Exhibit “A-4”
and made a part hereof, is hereby vacated.
The foregoing Ordinance was adopted July 10, 2008.
